Halt Expansion of Concrete Plant in Cape Charles, VA

The Issue

Eyre Baldwin and Southport has contracted to sell two properties to Coastal Concrete in Cape Charles.

Mr. Baldwin has made application to the Town for the re-zoning of parcel 90-8-1A1 (11 acre property surrounding FUJI/Waco) from Harbor with Wetlands to General Business Light Industrial Zone.  He has also demanded the language of the zoning ordinance be changed, effectively allowing the General Business Light Industrial to operate with the much the same uses as Coastal Concrete now have on their present M2 Heavy Industrial Parcels.

Furthermore, his letter to John Hozey attaches a draft of text changes on Coastal Concrete Letterhead, where the concrete company draft the exact text changes they require for the sale of land.

If that the one property be is re-zoned - coupled with the Text Changes demanded - then the adjacent larger 70 acre property 90-A-1A, that backs up to Bay Creek, which is already General Business Light Industrial - and also under contract for sale from Baldwin to Coastal Concrete - will to allow large-scale industrial uses. 

The Resolution of Intent to change the ordinance was rushed through on Tuesday night 7/13 in a Joint Planning Commission and Town Council meeting.   Town Council is set to vote on the deal at the Thursday, July 22nd  The Town Council Meeting at 6:30 pm. Public comments are allowed.  Individuals may speak for 3 minutes about their concerns and to request that Town Council defer their approval until some impact studies, development plans and a letter of Intent from Coastal Concrete is registered describing the business uses they will pursue if their Text Changes are written into the ordinance.

Coastal Concrete is seeking to purchase contiguous land,  some of which is currently zoned as Wetlands in Cape Charles, VA, to expand their operations including building structures as tall as 75 feet.  The land in question would be zoned for Light Industrial but the new Text Changes would allow for "assembly" and "storage" by the company in conjunction with this change of zoning. A new road abutting Bay Creek was also disclosed at the July 13th Joint Planning & Town Council session.
