Below is the account of Ben Freeman, 6 year old brother of Darcy Freeman, of what happened on the day his little sister was thrown 58 metres down West Gate Bridge, in Melbourne, Australia, on her way to her first day at school on 30 January 2009.
What is most disturbing about this case is who covered up the crimes of Family Court against little Darcy, her two young brothers, her mum (Peta Barnes) and her dad, Arthur Phillip Freeman?
The Attorney General did not find it odd that the Case Judge of this heart wrenching family's custody battle was no one but the notorious Honourable Diana Bryant, the Chief Justice of the Family Court (5 July 2004 to 13 October 2017).
The Attorney General did not find it odd or worthy of criminal investigation that Diana Bryant claimed the Court files were in her possession and supposedly in her unlocked car and allegedly stolen from the car on 7 February 2009 (a week after Darcy's tragic death).
The Attorney General did not find it worthy of criminal investigation when a lawyer turned Chief Justice, Diana Bryant, with the most horrifying and at best most questionable past history claims that the files that resulted in the murder of a 4 year old child gets simply stolen from her car, with no forced entry!! **
The Attorney General did not find it necessary for members of public to know and most importantly the devastated family of 4 year old Darcy, that the chief justice who has "lost" the case files was also the case judge of this case. Why was she also sitting as a judge on this case? She only chose to Hear extremely wealthy individuals' cases such as Alan Bond's daughter and many more.
What was so special about this case ?
The Attorney General did not find it worthy of public safety consideration that in 1975, the building where the criminal investigation into Diana Bryant's Family legal practice was being conducted where all documents of her family business fraud and embezzlement (In excess of $20,000,000) were kept, ALSO goes up in flames and burns down....!! Police investigation concluded the fire was caused by arson.
The Attorney General(s) kept Diana Bryant in her position for another 9 years after Little Darcy's tragic death (and Family court files "stollen" from Diana Bryant's car) as Chief Justice of Australia's Family Courts, putting in danger lives and livelihoods of Parents and children.
Like Diana and Betty Bryant's legal firm's record theft of innocent people's money, there is not much information available to public on Darcy's case. They are all classified and unavailable to public. But Attorney General(s) had (and have) access to them and for nothing but at least public safety could have considered making them available to public.
The Attorney General should have charged Diana Bryant with obstruction of justice and destruction of Court documents that would have perhaps spared the Father's life in prison for murder of his little girl,...., but did not.
Instead, the shameless and disgraceful Honourable Chief Justice was given carte blanche to put in place "laws" to silence Family Court victims and protect herself and army of judges she appointed and Report Writers to ruin the fabric of Australian society.
The question is how and why she had obtained so much unchecked power, considering her past?
What does she have against the people in power who could have investigated her?
Darcy was a blonde 4 year old. How many more Darcy's lives were destroyed under her rein of the most corrupt courts in history?
Is she blackmailing them?
She has no children of her own but has been in Family Law since its inception!
What dark secrets did she have against and was using to silence several legislative and judicial administrations?
How was she able to make into law the most protectionist and un-constitutional laws just to avoid scrutiny of her own conduct and those of Family Court Judges appointed by her?
And how no enquiries were ever made into Family Courts despite politicians admitting the need for an enquiry as far back as 2009?
Australian Attorney Generals:
1. Philip Ruddock (who appointed Diana Bryant in an airport lounge 24 hours after he offered the job to her only 9 months into his own term as AG)
2. Robert McClelland,
3. Nicola Roxon,
4. Mark Dreyfus,
5. George Brandis
(who whitewashed crimes of Family Courts by NOT recommending a Royal Commission but instead offering a toothless tiger ---parliamentary committee--- and on the last day did not allow Diana Bryant to testify and pulled her out)
and
6. Christian Porter
are all guilty of allowing Diana Bryant to stay at the helm of Family Courts until the final second of her 69th birthday while in courts under her chiefdom millions of lives were destroyed while the only item of business was the tainting the fountain of justice.
Until a thorough investigation by an Act of parliament is performed into the crimes committed under her rein in the Family Courts, the blood of Darcy and hundreds and thousand others are on the hands of those who appointed, protected and allowed her to stay in power while victims (and perhaps whistle blowers) were informing the Attorney Generals and Prime Ministers of the extent of corruption and fraud.

Who would destroy the files of a case where so many lives (three children, two parents) were destroyed?
Brother recalls Darcey's last moments By Selma Milovanovic 10 March 2011
---------------------------------------------
MOMENTS before her father threw her over the West Gate Bridge, Darcey Freeman played games with her older brother Ben in the back seat of a four-wheel-drive, as their toddler brother sat strapped in a child seat between them.
Darcey was pulling faces and making shapes with her hands while Ben tapped his knees like a drummer. They were on their way to what was to be Darcey's first day at school.
A few days later, a policewoman asked Ben Freeman, then six, about the day his sister died.
''We were driving along the road and when we got on the bridge we stopped. And then my dad went out with Darce and then he threw her over the bridge,'' Ben said.
''And then we keeped [sic] on driving and then we went to this weird, funny place … and then we keeped [sic] on swapping rooms till we went to the toy room.''
The video of Ben's police interview was played to the Victorian Supreme Court, where his father Arthur Phillip Freeman, 37, has pleaded not guilty to murdering Darcey, 4, by throwing her 58 metres to her death.
''She didn't even scream on her fall,'' Ben said. ''I didn't hear her scream on the way … no, nothing, nothing, nothing.''
Freeman walked back to the car silently and drove off, the court heard.
''I said, 'Go back and get her,''' Ben recalled. ''And then I said, 'Darcey can't swim,' … I kept on saying it over and over again and he never did it.''
In his child-like, list-making way, Ben went on to remember what else happened that day, January 29, 2009. Freeman drove his sons to ''this weird, funny place'' - the Commonwealth Law Courts building, site of a bitter custody dispute between Freeman and his estranged wife Peta Barnes.
Meanwhile, water police retrieved Darcey's body from the Yarra River. As paramedic Andrew Dale frantically tried to revive Darcey, his female partner noticed drawings the girl had made on her legs. At one point, Darcey's heart started beating. She had a pulse for about a minute but then she was gone.
Back at the court building, Freeman began to sob, so Ben explained to security guards who his family was. Ms Barnes's friends took Ben to McDonald's and a library while ''mum went to the hospital to see on Darce and then she stayed till she died and then what happened was I went to sleep''.
When police brought his mother home, ''I could have a seat in the police car and the sirens were on and he [the policeman] showed me the walkie-talkie things''.
Yesterday, Freeman did not take his eyes off the video screen. Ms Barnes's father - Darcey's grandfather - did not take his eyes off the accused. Freeman appeared emotionless.
Barry Nelson, a motorist who witnessed Darcey's death, remembered Freeman was similarly behaved when he saw him on the West Gate Bridge.
''The overwhelming impression I got was he was totally neutral,'' Mr Nelson said. ''Like he was mailing a personal letter and walking back to the vehicle. Had I not witnessed the incident I would not have known anything was wrong.''
Mr Nelson had earlier stopped his car, run to Freeman and asked him what he was doing but ''he never said anything at all''. As his wife screamed and cried in the background, Mr Nelson called 000 while watching Darcey floating in the water below.
Richard Claessens stopped his semi-trailer on the bridge and saw a boy sitting in Freeman's car ''raising his hands up and he was trying to look at the left-hand side of the car like he was looking for something''.
Another driver, Michael Piacentini, also called 000. He said he would never forget what he saw that day. ''I see it every time I drive over the bridge,'' he said. ''There was no hesitation of him lifting the child and throwing the child over. There was no reservation or second thought.''

Documents stolen from Darcey case judge

SENSITIVE documents relating to West Gate victim Darcey Freeman and her father have been stolen from a judge's car in the city.
The documents were taken from a car belonging to Family Court Chief Justice Diana Bryant.
The theft, on Thursday night, occurred only hours before Darcey was buried at a private funeral yesterday.
Darcey, 4, was allegedly thrown from the West Gate Bridge by her father Arthur on January 29, which was to have been her first day at school.
The Herald Sun believes the theft of the briefcase, which contained several files, did not involve forced entry.
The car may have been left open in Little Collins St, about 40m west of Spring St.
Police have been told the theft occurred between 7pm and midnight, but have not found security footage to identify the culprit.
A search of nearby lanes did not find the briefcase and police have made an urgent appeal for witnesses.
It is not known whether the thief knew of the contents of the briefcase.
The documents include transcripts of the Freemans' case.
It is not known if the material contains psychological reports.
In a statement released on Thursday, Darcey's relatives said the justice system had ignored their fears about her safety and had failed to prevent her death. Chief Justice Bryant confirmed a Family Court judge's car had been broken into and personal items, including a briefcase, stolen.
"There were no court files, but the papers included a transcript," she said.
Earlier, Chief Justice Bryant revealed she had reviewed all relevant reports relating to the Darcey Freeman case.
She was to hand over all available documents to the federal Attorney-General next week, after he called for a review of the Freeman matter.
"We'll co-operate in whatever way in making available to him all of the material and events that occurred," she said on ABC radio.
But she said the judicial system was not told of concerns that Darcey was at risk.
Federal Attorney-General Robert McClelland has asked his department to review the family's case.
"(This area of the law) is an extremely difficult area, and if there is anything we can learn from this tragedy to improve how the system is run, we will not hesitate to take the necessary action," Mr McClelland said in a statement.
Victorian Premier John Brumby welcomed the review.
"Anybody who has family or friends who dealt with (this area of the law), you know the system isn't perfect," he said.
"I think it's very timely to review this case and to see the way in which it was managed.
"It's a federal responsibility and I think the sooner that review's undertaken, the better."
