Demand California Pass : The Parental Amnesty and Equality in Divorce Bill
The Issue
We are petitioning the California State Legislature and California's Governor Jerry Brown to immediately adopt a new law that will assure equality for parents in the state's family law cases where support, custody and property issues are at hand.
We are further asking the state to immediately remove all mothers and fathers previously declared vexatious during a divorce or custody case from the state's vextacious litigant list.
The vexatious litigant statue is in direct conflict with the state's family laws and is being unevenly applied in family law cases across the state. The state can not fairly divide property, or assure that support and custody issues are equitable for parents and children when one party has a lawyer , and is naturally shielded from the vexatious litigant statute, and the other parent is forced to act as his or her own lawyer during a divorce.
On a whim, in a single family law case, the current law permits any judge in the state, the ability to declare a pro per litigant to be vexatious, restricting that person's rights during a divorce case, and also restricting that person's right to access the courts.
By definition the vexatious litigant statue is at odds with the state's family court laws , which seeks to assure legal parity and where the state legislature has sought to assure parents involved in divorce cases have legal parity.
Please join us in demanding that California abolish the vexatious litigant designation in and arising from all family law cases, and demand that any parent previously declared vexatious in a family law case, be immediately removed from the state's vexatious litigant list.
It is time courts in California be reminded it is the strong policy of the state, and the will of the people, to ensure parents in divorce cases have a legal level playing field when dealing with support, custody and property issues.
