Judge Wells refuses to believe that domestic violence in certain cases exist do to his unbelievable assumption that domestic violence occurs as a result of bilateral abuse. The family code specifies that domestic violence victims are entitled to separate mediation times when there is a history of domestic abuse and there is an active protective order. Judge Wells specifically orders victims to appear at the same time so that the domestic abuse increases in a situational abuse situation caused by Judge Dale Wells. This is even more heinous when the permanent restraining order contains a 100 yard stay away order and victims are FORCED into contact with their abusive ex-husband by Judge Dale Wells who refuses to "BELIEVE" in domestic abuse and wants to play cat and mouse games punishing victims with his heinous assumptions towards litigants in certain cases. CA family code 3181 specifies "(a) In a proceeding in which mediation is required pursuant to this chapter, where there has been a history of domestic violence between the parties or where a protective order as defined in Section 6218 is in effect, at the request of the party alleging domestic violence in a written declaration under penalty of perjury or protected by the order, the mediator appointed pursuant to this chapter shall meet with the parties separately and at separate times." Previous Judges have staggered mediation appointments recognizing the permanent restraining order. Judge Wells refuses to allow parties to appear separately. Judge Wells in open proceedings to attorneys declares that Judge Wells is not Judge {S xxx} and that the previous judge in Department 2 J had a "loose" department in the period in which this judge presided. The hatred towards this other judge is well known throughout the entire Riverside Superior Court and Judge Wells will refuse to abide by any orders issued by this judge. Judge Wells refuses to allow a reconsideration to be heard in front of this judge, "trailing" this request for order to a trial held in front of Judge Wells and wanted to take the request for order off calendar to prevent that it be heard in front of Judge S. Reconsideration hearings normally have to be heard in front of the judge who issued the original order that is subject to the reconsideration hearing.
