Problem
Mr. Hicks was convinced in 1988 for the crimes of rape, aggravated sodomy and aggravated child molestation. Mr. Hicks was sentenced to 3 life terms plus 100 years for crimes he did not commit. The victim had the Aids virus but Mr. Hicks did not, this would have been admissible under the rape shield statute to show that Mr. Hicks did not have sex with the victim but was never mentioned in court. Mr. Hicks did not know the victim had Aids untill 11 years after his conviction. Dr. Stark met with the victim, her mother and aunt and on 9/16/1987 Dr. Stark testified that the victim was not on any medication or had any major illness. This testimony was false, Dr. Stark knew the victim has the Aids virus. The sentencing judge stated his desire to impose a sentence of death, dismemberment and disfiguration but the judge chose not to do so because it would have been outside the sentence guidelines. This is just the tip of the iceberg there is much more to show Mr. Hicks is innocent.
