
Everyone ….. following a visit today from 4 local labour councillors who claim we are misinforming residents about the proposed development and how to submit your objections , I attach the latest updates which are issued by the local council and available to view on their web site for the plan applicable to Peaks Hill Farm and also how to send in your appeals / objections and representation which must be submitted by 21st October to that they can be submitted to the independent government inspector . If we can provide enough evidence that consultations were not clear and adequately provided for all residents of Worksop and surrounding areas like Carlton and Blyth for example will help our fight. I’m hoping the details attached will help you all be clear what we need to appeal against and how to do it .

Publication Version Local Plan
This next step in the Local Plan preparation process includes a seven (7) week long consultation on the "Publication Version" of the Bassetlaw Local Plan. This is the version of the Plan the Council thinks is ready for Examination by the Government. Before the Local Plan is submitted to the Government, the Publication Version of the Plan is made available for technical comments on whether it meets the "soundness and legal tests" set out in Planning Legislation. Representation are invited to be made between 2 September and 5pm Thursday 21 October 2021.
Soundness and Legal Tests.
As per Paragraph 35 of the NPPF, Local plans and spatial development strategies are examined to assess whether they have been prepared in accordance with legal and procedural requirements, and whether they are sound. Soundness means asking whether or not the Plan is 'fit for purpose' and 'showing good judgement'. The Examination will explore and investigate the Plan against the Government's four 'tests of soundness' :
• (a) Positively prepared - providing a strategy which, as a minimum, seeks to meet the area’s objectively assessed needs; and is informed by agreements with other authorities, so that unmet need from neighbouring areas is accommodated where it is practical to do so and is consistent with achieving sustainable development;
• (b) Justified – an appropriate strategy, taking into account the reasonable alternatives, and based on proportionate evidence;
• (c) Effective – deliverable over the plan period, and based on effective joint working on cross-boundary strategic matters that have been dealt with rather than deferred, as evidenced by the statement of common ground; and
• (d) Consistent with national policy – enabling the delivery of sustainable development in accordance with the policies in this Framework and other statements of national planning policy, where relevant.
Legally compliant means asking whether or not the plan has been prepared in line with statutory regulations,
The below link provides a form which we advise is completed. As we are at the ‘test of soundness’ stage of the process, any responses we get (at this stage) will go to the independent Government Inspector, so it is important that any responses we receive are clear.
