Protect Your Access to CBD and Industrial Hemp in New Mexico
The Issue
The passing of the 2018 Farm Bill brought with it a lot of hope that products containing CBD made from Industrial Hemp would be allowed to be sold in the marketplace without fear of prosecution from the FDA or DEA. Once the Farm Bill passed, within an hour of the announcement, the FDA put out a notice which includes the following statement - "We’ll take enforcement action needed to protect public health against companies illegally selling cannabis and cannabis-derived products that can put consumers at risk and are being marketed in violation of the FDA’s authorities. The FDA has sent warning letters in the past to companies illegally selling CBD products that claimed to prevent, diagnose, treat, or cure serious diseases, such as cancer. Some of these products were in further violation of the FD&C Act because they were marketed as dietary supplements or because they involved the addition of CBD to food."
The state of Colorado has taken steps protect their citizens and businesses from this kind of action by the FDA by passing the Colorado Hemp Foods Bill.
CONCERNING MODIFICATIONS TO THE "COLORADO FOOD AND DRUG ACT" TO ALLOW PRODUCTS CONTAINING INDUSTRIAL HEMP, AND, IN CONNECTION THEREWITH, ESTABLISHING THAT PRODUCTS CONTAINING INDUSTRIAL HEMP ARE NOT ADULTERATED OR MISBRANDED BY VIRTUE OF CONTAINING INDUSTRIAL HEMP.
We need to adopt this kind of legislation in New Mexico to make sure that the citizens of New Mexico continue to have access to products containing CBD, and so that businesses can continue to provide access to these products without fear of prosecution.
