Dear FOMC Petition Supporters

Season’s Greetings to all of our neighbors and Friends of Mountain Creek. Our current petition enrollment includes over 5,300 like-minded neighbors.  It has been about nine months since the PUD application for the development at the Quarry was debated and decided at City Council. Since that time, our new Mayor's staff, our Councilman and the City Attorney have been engaged in a variety of resolution paths for the Quarry. None has been established yet.

Having been delayed for an extended period, we were expecting that the developer’s lawsuit against the city regarding clubhouse zoning would finally be heard this past spring. However, the District Court Judge who had been assigned the case has retired. Since then, the case has since been assigned to another District Court Judge. The date for its hearing has yet to be announced.

Also in regard to this lawsuit, in an attempt to reduce the number of open lawsuits filed against the city, Mayor Kelly instructed the City Attorney to seek a settlement with the developer. Meetings between the developer and city attorney failed to find a compromise position.

With regard to the balance of the property, it remains zoned R-1. Following the denial of the PUD application in March the developer threatened FOMC with the prospect of selling the property to a developer known for building entry homes on slabs. Since any developer would be required to follow the same set of R-1 rules (which currently allow for much smaller lot sizes than are present in the surrounding subdivisions), and since he has all along intended to “cram in as many doors as possible”, that threat is viewed as inconsequential.

Since March, representatives of FOMC have met with City Council members to continue to solicit their support. FOMC representatives have also recently met with our new Mayor’s staff to discuss the “FOMC Vision for the Quarry” or the Seven Reasons Why the Quarry Should Remain a Green Space.  This discussion is summarized in the attached document.

Realizing that there has been turnover in our neighborhoods and regardless of the outcome of the impending lawsuit, FOMC would like to reinvigorate our petition drive, seek the support of our new neighbors and to continue to aspire to the best outcome for this community. If you have new neighbors, please discuss our petition with them and ask them to sign.
