Best Buy and NVIDIA Fair Consumer Rights Practices

The Issue

Nvidia has chosen BestBuy as their sole reseller of the Nvidia line of graphics cards. Their RTX cards are amongst the most popular cards on the market today. This would not be a problem except BestBuy has refused to cater to the average consumer.

 

BestBuy has no safeguard to prevent bots, miners and scammers to buy these cards at MSRP in bulk through single or multiple accounts the very second these cards are entered into inventory.  Selling them out in seconds after availability. This could be easily remedied by implementing captchas on their store pages or by limiting refresh times per minute of their pages to prevent bots from trolling the storefront. BestBuy does none of this. These scammers take the cards that they buy at cost and resell them on other marketplaces for 3+ times the cost. This is why a Nvidia RTX 3070 card typically 499.99 at MSRP sells for 1800.00 on other marketplaces!

 

Now BestBuy has implemented "TotalTech" their solution that is nothing more than a subscription service for 200.00 a year that gives consumers the RIGHT to make a purchase. Who is more apt to pay that, the average consumer who just wants one item or a scammer who makes up the cost with one resell?

 

By allowing this business practice to continue the average consumer is being mistreated, disrespected and ignored. The scammers are getting rich so they can buy even more of these cards at cost and the average consumer is unable to get what they desperately need. 

 

This needs to stop NOW!! This has nothing to do with chip shortage. The cards are available, limited yes, but they are not being allowed to go to the consumer where they belong.
