The Issue

Join the Largest Class Action Lawsuit in Kenya’s History & Demand Compensation!

Taifa Mpya in Partnership with Advocate Joseph Mwai, Wanjiru Githiomi and others, are spearheading a landmark case on behalf of ALL Kenyans—and potentially the entire continent of Africa. Invoking Article 46 of the Kenyan Constitution and the Consumer Protection Act, we have sued  ALWAYS, KOTEX, HUGGIES, AND PAMPERS, for endangering our lives and lying to us.

Did you know that ALL sanitary pads, diapers, tampons and wipes sold in Kenya are NOT made from COTTON. They are packed with OVER 20 DEADLY SYNTHETIC CHEMICALS, including carcinogens and "forever chemicals" that will NEVER leave your body.

Kotex tampons and pads? Same nightmare—"forever chemicals" heavy metals, and pesticides.

Even trusted diaper brands like Huggies are poisoning our babies! Their so-called "100% organic cotton" claim is a LIE. These diapers are toxic—laced with chemicals that put your newborn’s health at risk- this is FALSE & MISLEADING ADVERTISEMENT.

WHAT ARE THE HEALTH RISKS?
Exposure to these poisons leads to: Infertility, Low birth weight, Pregnancy complications, Cancer, Developmental delays in children, Birth defects, Weak immunity, Weight loss, Skin irritation, Hormonal chaos, Toxic shock syndrome, High cholesterol, Thyroid disease, Liver damage, Kidney and Testicular cancer, Asthma, Allergies, and Reduced vaccine effectiveness in children among other things.

OUR RIGHT TO COMPENSATION
We demand the immediate withdrawal of these harmful sanitary products and diapers and their replacement with 100% cotton versions.

In addition, we are seeking punitive damages because Article 46(1) (d) of our Constitution and Sections 16 and 84 of the Consumer Protection Act guarantee that every consumer has the right to compensation for any loss or injury caused by defective goods and services

This right was upheld in June 2022 by the late, Honorable Justice David Majanja in the case of Itakura v Odera. He confirmed that—Section 84(3) of the Consumer Protection Act empowers the court to impose punitive damages, over and above any other remedies. Justice is on our side!

On Tuesday, 15th October 2024, we appeared before Justice Chacha Mwita with over 1000 petitioners. Desperate and scrambling, the defendants attempted to argue that they were not the distributors—but Justice Mwita REFUSED to entertain this baseless excuse. The court ordered them to file their Replying Affidavit ensuring that the main petition proceeds to the next stage! This was a major VICTORY!

The final submissions are set for the 27th of March 2025, after which judgment will be passed.

THIS IS THE LARGEST CLASS ACTION LAWSUIT KENYA’S LEGAL HISTRORY
For every petitioner, we shall be demanding no less than KShs. 500,000 (Kenya Shillings Five Hundred Thousand) as compensation for the harm inflicted by these FALSE AND MISLEADING ADVERTISED products.

We already have over 1,900 petitioners standing strong, but we are not stopping there. We are aiming to hit them where it hurts most—their pockets. Our goal is to gather at least 10,000 petitioners before 10th November 2024. The more people who join this movement, the LOUDER and STRONGER our demand for justice will become!

PLEASE SIGN this petition. WE DEMAND JUSTICE AND FREEDOM FROM TOXIC DIAPERS AND SANITARY PRODUCTS.
