Ban the Sale of Galaxy Gas in Schenectady

Ban the Sale of Galaxy Gas in Schenectady
The Issue
The increasing sale and use of nitrous oxide, commonly known as Galaxy Gas, within Schenectady, NY, is a growing public health and safety concern. Though often marketed as a harmless recreational product, nitrous oxide misuse can lead to serious health consequences, including neurological damage and even death.
Because of its legal yet unregulated status, nitrous oxide has become dangerously accessible—especially to youth. Its rising use has been linked to antisocial behavior, impaired driving, and environmental hazards from discarded canisters littering our streets. It is critical to educate our community and implement local controls that restrict access to this substance.
We are urging local authorities, including Schenectady City Council and other legislative bodies, to take immediate action by:
- Banning the sale of nitrous oxide outside of a grocery store
- Make a plan to ensure adherence to New York General Business Law § 399-hh
- Regulating and licensing sales to ensure legitimate use
- Launching public awareness campaigns about the dangers of recreational use
Our city deserves safe neighborhoods, informed policies, and protection for our youth. With your support, we can reduce the harm caused by unsupervised access to Galaxy Gas and advocate for a healthier, safer Schenectady.
Sign the petition today to help bring this issue to the forefront and demand meaningful legislative and community-based action.
Legal Landscape: Nitrous Oxide Sales in New York State
New York Public Health Law § 3380
Prohibits selling or delivering nitrous oxide for inhalation unless it’s for lawful medical, dental, or industrial use. Vendors must not sell for recreational inhalation purposes.
New York General Business Law § 399-hh
Requires retailers to post clear warnings about the unlawful use of nitrous oxide. Failure to comply may result in fines and penalties.
Inspiration from Other States
Minnesota SF1215
Minnesota passed legislation banning retail sales of nitrous oxide canisters unless to verified businesses with legitimate uses. This model shows how local action can protect communities.
Let’s act now. Together, we can advocate for commonsense policies that limit access, inform the public, and help keep Schenectady safe.
