The Issue

Michigan communities are finding out their neighborhoods are about to host massive data centers only after the deal is already done. That's because public officials in Michigan can currently sign non-disclosure agreements (NDAs) — legal promises to keep quiet — about data center projects before residents ever get a say. By the time people learn what's coming, it's often too late to ask questions about water use, energy strain, or how the project will change their community.

Lawmakers in Lansing have a chance to fix this. Michigan Senate Democrats introduced a bill this year that would ban public officials from entering into NDAs tied to data center deals, alongside requirements for water-use permits and community benefits. Similar transparency measures have been proposed in the House. But months later, both packages are stuck in committee, with no vote in sight.

"Data centers have already corroded trust in our government, and have shown real flaws in transparency at the state and local level all over our state," said Chris Gilmer-Hill, policy manager for the Michigan Environmental Justice Coalition, at a September 9 press conference at the Michigan Capitol.

Residents deserve to know what's being built in their backyard before the ink dries, not after. Michigan lawmakers should move these transparency bills out of committee and pass a ban on secret data center deals now.

Sign the petition to demand Michigan lawmakers end secret NDAs on data center deals — before another community is blindsided by a project it never got to weigh in on.

“Thank you to everyone who has signed this petition urging action to ban secret NDAs in Michigan data center deals. We acknowledge your concerns. I want to share that a data center guardrail package was recently introduced in the House that specifically addresses the NDA concern, among many other concerns. In addition to promoting transparency by preventing public officials from entering nondisclosure agreements related to tax-incentivized data center projects, the package includes protections for ratepayers, workers, local communities, and our environment. • https://housedems.com/andrews-fellow-democrats-introduce-comprehensive-legislative-package-putting-guardrails-on-data-centers/ House Bills 6135–6142 were introduced on June 25, 2026, and referred to the House Committee on Government Operations. To date, the committee has not held a hearing or taken action on the bills. Please contact the committee and urge its members to schedule a hearing and advance the data center guardrail package. “Thank you for reaching out regarding data center development in Michigan. I share your concerns about the impacts on local infrastructure, utility costs, and our water resources. Community well-being must always come first, which is why I strongly support a moratorium on new facilities. To hold developers currently operating in Michigan accountable, I have sponsored Senate Bills 1049, 1050, and 1051. https://senatedems.com/camilleri/2026/06/18/democratic-legislators-aim-to-hold-large-scale-data-centers-accountable-protect-michiganders-and-environment/ This legislation bans public officials from entering into non-disclosure agreements (NDAs) that conceal project details. It also amends zoning laws to require community benefit agreements before construction begins, ensuring that residents’ health, safety, general welfare, and surrounding natural resources are protected and prioritized. These bills are part of a broader package that mandates a separate utility rate class for high-energy users, ensuring corporations pay their full share of electricity and infrastructure costs to prevent any rate hikes for our residents and small businesses. Additional measures include strict water permitting, public review requirements, and state wastewater monitoring to protect Michigan’s lakes, rivers, and groundwater. My concerns with AI go beyond physical data center infrastructure. This is why I introduced the Responsible Artificial Intelligence Security for Employees Act (RAISE Act) to set standards for workplace AI, curb employee surveillance, and prohibit the use of AI to determine wages. Decisions of this scale must never burden local residents or jeopardize our natural resources, and your feedback remains vital in shaping the guardrails we fight for every day in Lansing. I look forward to working with our next Governor to put a moratorium on new data centers in place. Please don't hesitate to reach out to my office if I could be of any assistance to you or your loved ones.”
