Ban Sainsburys unlawful barrier system
The Issue
Sainsburys have installed an unlawful barrier system. It is depriving the liberty of movement of human beings who are being held hostage, on the negotiation they provide a receipt for liberation. This came to my attention when I lost my receipt and could not exit. I approached 3 members of staff who told me and quote,
“We are Unable to allow people to leave without a receipt.”
this is imprisonment. This is against human rights, particularly because consumers are not providing consent to have movements restricted and are being accused of shoplifting in the absence of any grounds for suspicion. When I complained to the company, they stated it is no different to needing a ticket to lift the barrier of a car park and stand by their unlawful activity. I had to explain to them that within a car park, it is the car which is bound to the property, not human beings! The human is free to leave and abandon their vehicle should they choose not to pay their ticket. The system sainsburys have adopted is oppressing and restricting free movement and liberty of human beings. Furthermore, the carbon footprint of enforced continual receipt printing is damaging the planet. They made no comment on this.
sainsburys either need to remove the barriers, or completely remove self checkouts if they can’t trust their shoppers!! Every single customer since 2022 has the right to sue the store, see below.
Legislation
Under s 24A of the Police and Criminal Evidence Act 1984,
you’re entitled to detain a person only if you suspect of shoplifting, as long as you have reasonable grounds for this suspicion.
Under s 3 of the Criminal Law Act 1967
You may only use force that is reasonable or proportionate to a crime
Deprivation of liberty
Mental Capacity Act.
Being deprived of liberty means that you're not free to go anywhere without permission or close supervision. It also means that you're continuously supervised. This is against the law unless lacking mental capacity.
