Petition updateScenic Rim Regional Council - have now tortured our Bandit 3 years 9 days in a 1.2m cellBandit needs your help as it's 8 months now

Bandit CutbushQLD, Australia
Apr 2, 2018
Sorry we haven’t posted as we have been very busy in QCAT saving BANDIT.
BANDIT remains in filthy conditions after 8 months at the Scenic Rim Regional Council torture centre on Helen St,Beaudesert,QLD with the blessing of the so called “inspirational” back slapper Scenic Rim regional Council Mayor Greg Christensen.
We visit each day but at this stage he is very quiet but Paul did hear him on Saturday which was the first time in 2 weeks.
BANDIT as a Registered, Papered, Purebred Red Cattle Dog is a very, very smart dog and our advice from experts is that Australian Cattle dogs can adapt as he has had to.
He hears us but we reckon sometimes he is just too sad to say hello along with being very confused as to why we don’t let him out.
It is eating away at us.
The Council have not provided a photo or allowed us to see him since 14 October 2017 and he has been through a flood and 3 heatwaves.
They are very nasty, aggressive, punitive and cruel people.
We know it is a criminal act and it will not stand for Bandit or any other pet.
When you take on a corrupt Council, a corrupt Mayor and a corrupt RSPCA CEO it is hard. What these entities didn’t expect is our resolve and your support in saving BANDIT from this overt corruption.
Our matter is in both QCAT and the QLD District Court yet the RSPCA (due to negative donation impact) have now published a short story on their blog which is not only inaccurate but defamatory and a breach of privacy.
So just to correct some of the untruths published or avoided:
Mark Townend, CEO RSPCA QLD is a former Logan Council Manager, former auto spare parts Manager (no Animal Behaviour qualifications) who released private information about BANDIT and ourselves to his Daughter SAMANATHA TOWNEND who then made defamatory comments on Facebook In October 2017. SAMANTHA TOWNEND runs a dress shop and is not an RSPCA employee. We did not approve the release of RSPCA information to a non RSPCA employee. The person SAMANTHA TOWNEND then began harassing us on Facebook.
We have provided a formal Concerns Notice as per he QLD Defamation Act to both parties and the Federal Information Commissioner is also investigating.
Amazingly Mr Tribe the QLD RSPCA Chairman has failed to respond to any correspondence.
The RSPCA have failed and continue to fail in their duty to animals as delegated by the QLD Government under the Act in allowing BANDIT to be subjected to ongoing torture in a 1.2m cell for 8 months eg: no visitations, no fresh air, no sunlight, no exercise, no vet care and no ability for to defecate except in his own area. He is sprayed twice a day with a fire hose.
All of this is an embarrassingly overt breach of the RSPCA Freedoms but they choose to ignore these and claim BANDIT is a “dangerous dog”.
I texted Mark Townend on Tuesday 7 November 2017 and he responded at 0633am Wednesday 8 November 2017 after I asked him what evidence he had and this is his response:
“Paul I don’t know the evidence that the council have to hold or even consider euthanizing Bandit, but if they are operating lawfully and morally they should process the information”
Yet the RSPCA then published on their “blog” extensive details of false allegations against BANDIT ?
Obviously, all provided by the corrupt Scenic Rim Regional Council and also the blog then claims its all the “owners” fault?
I have an affidavit from Towend confirming he “directed” that BANDIT be shipped back to the Scenic Rim facility even though he knew welding and building works were underway. This is the CEO RSPCA QLD taking personal action against our pet. He denied that in Court and it is perjury.
The RSPCA never conducted any investigation and basically did a deal with the Council to allow them to not get a breach notice. The RSPCA Inspector RENEE LAW took over 2 weeks to visit the Pound and by that time BANDIT was over it as he had been in a 1.2 m cell being sprayed each day. The Ranger failed to accept any video or evidence and was on very good terms with the Council Rangers.
We have escalated the matter to both the RSPCA QLD Chairman Mr Tribe and also the National Chairman Mr Humphries. Mr Humphries seemed concerned but was ineffective.
It’s obvious Townend is running a fiefdom up here in QLD with no governance He also claims even though the RSPCA Prosecutor was in the District Court that the RSPCA is not spending thousands on Barristers.
Do not donate to the RSPCA as it very obvious they have an overt conflict of interest between animal welfare and profit.
Just an update on QCAT. It’s now 8 months and the Scenic Rim Regional Council have failed to provide any evidence to QCAT and missed all required timelines.
We had a Directions Hearing last Friday and our Lawyer has stressed the urgency for Hearing. The Council again provided no evidence.
A number of people including Mark Duncan,Ranger Scenic Rim Regional Council who is behind the theft and torture of BANDIT is currently under investigation in a Crime and Corruption Commission directed investigation at the Council.
We don’t know how BANDIT is and obviously remain very concerned about his mental and physical state.
Thankyou all again for your ongoing support and we do believe people power will get him home.
We have attached a number of emails below from CEO Townend.
We can’t quite believe he would release our details to his Daughter.

Dear Mark,
• Why are you releasing private information regarding ourselves, our escalation to the Minister, Bandit, our visits, Beaudesert facilities etc. to your Daughter Samantha Townend?
• Samantha has posted details about my Family on Social Media that could only have been obtained from you?
• Why with no investigation or evidence of our cancelled visit Saturday are you abusing me below as the CEO RSPCA?
• Why has the RSPCA not updated us on the status of the RSPCA investigation after our cruelty complaint re the SRRC in mid September 2017?
• Why have the RSPCA failed to advise me of the daily regime for Bandit and diet etc?
• Your Inspector Law advised that she directed the Council to move him to a safe location. Why was he not uplifted to RSPCA care re another pound where he has no exercise and has not been vaccinated?
• Why did the RSPCA not lodge my accident at the DAKABIN site on 11/10 where I suffered serious injury?

Mr Cutbush
I wouldn't be wasting your time travelling to Dakabin as you were advised by Scenic Rim council lawyers King and Company that visitations have been cancelled.
You again need to be reminded the animal was seized under local government legislation not animal welfare legislation. You threat of legal action to RSPCA over an alleged incident has also meant RSPCA has needed to now pass the whole incident onto DAFF.
The issue of Samantha putting something is completely false, after she had enquiries from a couple of people that knew her and my relationship she PRIVATE messaged those people asked the reference to this be taken off pages associated with her and have those people my phone number to contact me directly.
You obviously use a modus operandi of threats, bullying and harassment which will not intimidate myself of the RSPCA.
What we won't put up with is the tirade of disgusting abuse my Dakabin manager my endured in the last couple of days hence my decision to support Councils visitation advice

Dear Claire,
I confirm that Sarah and I will be in attendance on Monday 16/10 as confirmed below and as you agreed today during our visit today.
I understand that on Monday (as you forgot Wednesday) Bandit will receive his very overdue vaccination. We requested the SRRC give us vet access on 12/9/17 with no reply.
As you know Bandit was subjected to very serious cruelty by the Scenic Rim Regional Council for 4 weeks prior to his unannounced arrival at your facility.
Bandit has now had no exercise for 6 weeks and we remain very concerned for his health and wellbeing.
As you advised on Wednesday you are discussing the issue of Matt Wooley of the MBRC claiming that Bandit is in the care of the RSPCA with your State Manager as you confirmed that is not accurate .I note that you advised you would escalate that matter to your State Operations Manager. You also requested his email detailing denial of MBRC involvement which I provided . You also confirmed to us that Bandit is not with the RSPCA but the MBRC

As I mentioned yesterday Bandit is still under the control of Scenic Rim Council, being the subject of a Scenic Rim Council investigation. Unfortunately we do not have any authority to take control of Bandit or to prevent Scenic Rim Council from moving him at any point. Bandit was moved by Scenic Rim Council due to concerns relating to his living conditions, this does not change the council process. If you have any further concerns you will need to consult with your solicitor and the Scenic Rim Council.
We can absolutely accommodate a visit next Wednesday at 11.30am. I will reserve the appointment for you now.
In terms of weekend visitation, as mentioned we have limited staffing resources on weekends which is why we are generally unable to offer appointments across weekends, especially at such short notice. However we would really like to assist you to see Bandit as much as possible - I may be able to accommodate a one-off weekend visitation on Saturday the 14th. I can't make any promises, but I'll see what I can arrange for you.
Dale is working with the seized council dogs today. He has reported that Bandit has eaten his full meal again which is a great sign, and is looking well.
We look forward to seeing you next Wednesday.

You do not have our authority to release him to the toturers
I suggest your refer to Beenleigh D 26/17 which is on foot in the QLD District Court against the Srrc
I will join you to that matter today as it is an injunction to ensure Bandit stays at Dakabin.

Paul

Hi Paul,
Not a problem - we are glad we could be of assistance.

Regards
Paul
