Thankyou everyone for your ongoing support. We have made some progress in getting Bandit to safety but more hurdles still.
On Thursday 5 October 2017 after RSPCA directions the SRRC transferred Bandit from their disgraceful facility at Beaudesert to the Dakabin MBRC Pound facility which is run by the RSPCA and next to the RSPCA Centre. The SRRC refused to allow us to be involved in the transfer so "poled" him which was unnecessary. We visited yesterday which was a 186 km round trip.
As you can see in the picture below of the unmanned Scenic Rim Council Facility he has been held in a 1.2m cell ,with no bedding and in his own waste for 4 weeks in heatwave conditions. He is very underweight and was depressed and filthy. The cell had a hole at the back where they sprayed out the waste (rarely) which also would allow a snake easy access from the isolated industrial street.
Yesterday at 1145 am at Dakabin the RSPCA Inspector, The Dakabin Facility Manager and the Dog Care Manager joined us in the visit and allowed me to give him a good thorough wash, massage and to play with him for around 30 minutes.
Unfortunately the Dickensian and punitive policies continue and Sarah was not be able to enter his pen and my Wife couldn't even view from outside.
The good news is that Sarah was able to touch him for the first time in 4 weeks and they have had him checked by a Vet (something the SRRC refused to do since we requested it 4 weeks ago), are feeding him more and have provided him with treats, daylight, modern facilities, sanitation, bedding, treats, toys, flea/tick treatment and experienced carers.
The next step is to get some exercise and vaccination for him.
Thankyou to Mim and Edith and others for their advice re the legal side of things.
During the first week of the un lawful impoundment I lodged a claim and statement of claim in the Beenleigh District Court Matter Number D 26/17 against the Scenic Rim Regional Council for compensation covering the recovery of Bandit and my Daughter. Specifically also requesting an injunction on detrimental any action against him.
The Council have supported my case with the last 4 weeks of torture and breaches of the Animal Protection Act.
The Council appointed a guy called Mark Williams at King and Co who is an absolute shocker and refuses to meet or talk to us on the phone.
I can not afford a Lawyer and have contacted the Barristers Animal Welfare Panel Coordinator here in QLD for guidance.
That said as a lay person I have worked in Justice,Law Enforcement & Corrections for many years and have successfully won some major personal cases in the QLD Supreme Court and QCAT.
So I am Bandits self represented litigant.
When I saw him just before the long weekend at the SRRC facility (and then the Council banned me from visiting) he was going downhill. I shouted at the Council Officer John Morrison "he has to come out...you are killing him" He said "no comment".
Then the next day Mark Duncan the Team Leader who oversees the SRRC torture centre said "talk to the Lawyer".
Amazingly these people are QLD Public Servants breaching the Animal Management and Animal Protection Act yet no one is watching them.
It appears the RSPCA rely on "education" versus ensuring that Councils are compliant.
The RSPCA we believe should have moved quicker as it took 2 weeks to get him transferred with almost no communication. They seem very focussed on privacy which as the pet owner is ridiculous.
So our issue now, and I am lodging further legal papers on Monday is that we have now heard that the SRRC are carrying out urgent building works at their Pound ( I would call it a cover up as I have extensive video/photos/sound files of the facility) to make it compliant.
The SRRC are now suggesting to Dakabin that they take Bandit back in 2 weeks !!!
This can't happen and I am lodging an interlocutory injunction on Monday.
Yesterday I spoke to the Local Government Ministers Office requesting a meeting to be told "he is at a funeral" he is "very busy" and they will "get back to me"
Bandit was very good yesterday even though underweight. The RSPCA don't allow photos but Ill put up a shot from their website. Bandit now has a run and can see daylight!
So the Free Bandit Campaign continues with your help and we are now at 747
Thanks Paul
