The Issue
You must be aware that the Govt. of India, through an amendment in the Cable TV Act, has banned transmission of 24 channels within the territory of India w.e.f. December, 2012. The ban includes transmission of channels like Peace TV, PTV, QTV, Madani TV and twenty others. Proposed penal provisions for the offence are as follow –
First offence – 2 years of imprisonment or fine of Rs.2 lakh or both.
Second offence - 5 years of imprisonment or fine of Rs.3 lakh or both
It is being observed that despite the ban imposed by the Union Govt, some MSOs (Multi Services Operator) and local cable operators are still transmitting the banned channels like Peace TV or PTV on their networks in different areas of West Bengal. Local administrations are also not initiating any action against them due to their unholy nexus with the concerned operators.
This being the case, the Information & Broadcasting Ministry, therefore, must take cognizance of the serious nature of the case and initiate proper action against the defaulters as stipulated in the law.
