Arnab Goswami - Apologise for making irresponsible statements against Nagaland Public Lynching and Inciting Hatred.

The Issue

Arnab Goswami must apologise for supporting public lynching of a rape accused Syed Farid Khan (arrested on 25 February 2015) by 10,000 people in Dimapur, Nagaland on March 5, 2015.

Arnab made factually incorrect statements, justified mob violence on false ground of the victim (who is dead after the fateful incident) being an outsider. By passing such statements he has demeaned the civil society and justice system of India. We believe that Arnab must issue a public apology for sensationalizing the issue and admit that me made a mistake.

While endorsing violence, we believe that Arnab has infringed following:

1. Reasonable restrictions under the Freedom of speech and expression Article 19(2): Challenged the sovereignty and integrity of India, the security of the State, friendly relations with foreign States, public order, decency or morality, or in relation to contempt of court, defamation or incitement to an offence".

2. Section 153 A of the Indian Penal Code: Whoever (a) by words, either spoken or written, or by signs or by visible representations or otherwise, promotes or attempts to promote, on grounds of religion, race, place of birth, residence, language, caste or community or any other ground whatsoever, disharmony or feelings of enmity, hatred or ill-will between different religious, racial, language or regional groups or castes or communities, or (b) commits any act which is prejudicial to the maintenance of harmony between different religious, racial, language or regional groups or castes or communities, and which disturbs or is likely to disturb the public tranquility, . . . shall be punished with imprisonment which may extend to three years, or with fine, or with both.

3. Section 295(A) of the Indian Penal Code (IPC) enacted in 1927:
Whoever, with deliberate and malicious intention of outraging the religious feelings of any class of [citizens of India], [by words, either spoken or written, or by signs or by visible representations or otherwise], insults or attempts to insult the religion or the religious beliefs of that class, shall be punished with imprisonment of either description for a term which may extend to [three years], or with fine, or with both.
