Judge Rodda Issues Order In Our Complaint

Stacey Champion
Phoenix, AZ, United States

Apr 10, 2019 —

Hi everyone. 15+ months later, here we are... I just finished reading the Judge's ruling on our Complaint which you can read HERE. (Judge Rodda's order, which dismisses our Complaint, begins on page 90.) It's not good, but this David vs. Corporate Goliath battle definitely isn't over, as it will go before the full Commission at the open meeting (tentatively scheduled for April 23 & 24) which I will keep you posted on, as we are going to need to PACK THAT ROOM so they can hear from us. Three Commission seats will be opening up next year, so it will be good to remind the Commissioners whose best interests they're supposed to be representing, and it's certainly NOT the utility monopoly. Here's the AZ Republic story on the order.

There has also been a fair amount of press over the past couple of weeks about APS/Pinnacle West spending on campaigns & elections, including the Commissioners who rubber stamped the rate hike (minus the lone no vote of Commissioner Burns who has both a spine and a conscience). Here's just one of the stories, reported by Phoenix New Times.

Please know this. I am not giving up, and neither should you. Though it may feel like we're taking 3 steps forward and 2 steps back, this IS making a difference and we must keep fighting. We will be filing our exception into the Docket (which I will update you on) and I am still an Intervenor in the Rate Review Docket (on my own without the assistance of an attorney, so we'll see how that goes). Ironically, I just submitted my first Data Requests to ACC Staff and APS yesterday, and filed them into the Docket today, so if you're interested, you can read the questions that I asked in that request HERE. With that said, it is more important now than ever to submit your comments about this Order, how the unjust rates are hurting your families, and your general outrage into BOTH of these Dockets - our original Docket No. E-01345A-18-0002 AND Docket No. E-01345A-19-0003. You can call the Utilities Division at: (602) 542-4251 or 1-(800) 222-7000 (Toll Free In-State Only). In my opinion, the 2018 Rate Review is a sham because of numerous things pointed out by my expert, but I'm sure they'll continue to play their very lucrative shell game for as long as possible. Let us not forget this is a multi-billion dollar utility monopoly indebted to their shareholders above all else...

I also want to sincerely thank my attorney, Adam Stafford, my expert Abhay Padgaonkar, Intervenors Woodward & Gayer, and every single person who has contributed to the legal fund thus far. Without all of you, we never in a million years would've gotten this far... And should we be put in a position where we need to push forward, we may need to ramp it back up.

Onward, and in the wise words of Margaret Mead: "Never doubt that a small group of thoughtful, committed citizens can change the world; indeed, it's the only thing that ever has."

With gratitude,

-Ms. Champion
