Appoint commissioners for Miscarriage of Justice Review Commission
The Issue
In a system where justice should be paramount, my son, a dedicated lawyer who believes in defending the innocent, has found himself on the other side of the law, wrongfully convicted. This is a personal battle for truth, fairness, and a just system. Unfortunately, countless others find themselves in similar positions without the means to fight back, and it is with this understanding that we call upon the Canadian Government to act immediately.
In December 2024, Bill C-40, also known as 'The Miscarriage of Justice Review Commission Act' or "David and Joyce Milgaard's Law," received Royal Assent, marking a pivotal step toward addressing and rectifying wrongful convictions across Canada. The Act promises the formation of the Miscarriage of Justice Review Commission, yet, despite its legal status, it remains non-operational due to the absence of appointed commissioners.
The immediate appointment of commissioners is not only a legal necessity but a moral imperative. The Commission is intended to act as an independent body, designed to review potential miscarriages of justice and support those who have been unjustly convicted. For victims of wrongful conviction, every day of delay is a day of injustice.
Statistics show that wrongful convictions undermine the integrity of our justice system and erode public confidence. According to the Innocence Project and legal studies, thousands of wrongful convictions occur globally due to flawed procedures or evidence handling. Such errors must be addressed with precision and urgency.
We are urging the Canadian Government to expedite the appointment process of the commissioners to bring to life the Miscarriage of Justice Review Commission. Establishing this Commission would ensure a systematic approach to reviewing wrongful convictions, thus protecting the rights and freedoms of every Canadian.
