Appeal mental health diversion decision for Zack Scrivner case

Appeal mental health diversion decision for Zack Scrivner case
The Issue
In the heart-wrenching case of Zack Scrivner versus The State of California, the decision to allow mental health diversion is deeply concerning and a painful reminder of the flaws within our criminal justice system. As a dedicated victim advocate, I am compelled to address the factors that continuously silence survivors, prevent fair and just trials, and disturbingly allow perpetrators to walk free.
Zack Scrivner has been charged by the California State Attorney General with charges that include allegations of child abuse, child sexual assault, and access to unregistered firearms. The decision, against the efforts of the Attorney Generals office, to offer mental health diversion in this serious case is not just a miscarriage of justice, but also a profound disservice to the victims, who are left without the closure and safety they deserve.
Mental health diversion, while well-intentioned in some scenarios, should not apply in cases intertwined with such grievous crimes. The allegations against Scrivner are too severe to be addressed with an outcome that could ultimately lead to evasion of accountability and lack of long-term protection for the community.
This petition urges the relevant judicial authorities to reconsider their decision and evaluate the broader implications and potential risks associated with allowing mental health diversion in this matter. The State of California must prioritize the safety and justice for all its residents, particularly the victims who are most vulnerable. The Attorney General’s office should have filed the case correctly with a 288 or 289(j) that doesn't require specific intent. If they would have Scrivner would not have been eligible for diversion due to the nature of these charges.
I implore all concerned citizens, fellow advocates, and those who value justice to join me in demanding the appeal of the mental health diversion decision in Zack Scrivner's case. Let us stand united in ensuring accountability and justice are upheld, preventing the further establishment of dangerous precedents.
Please sign and support this petition to bring justice where it is due and to stand firmly with survivors of violent crimes. Our collective voices can catalyze the necessary change for a just and equitable system.
