Children Visitation laws in Texas
The Issue
Texas needs some improvement to some of their family laws. If you share your child visitation time with someone else, you likely live by court orders. The orders tell you when you get your children, as well as when you do not. The problem here lies when you do not get your children during your court ordered time, the family and penal laws are severely lacking. If your children are not turned over to you during court ordered time and you call the police, they will tell you it is a civil matter and you can talk with an attorney. If you ask the local DA, there is a penal code that applies, but it is really used if someone took your children out of the county, and it is almost never enforced since it is a state jail felony.
If you have the money to hire an attorney, they can bring you to court and file a motion to clarify. If this is not obeyed, you can again pay an attorney to go back to court again, and then they can file a motion to enforce. If this is not followed, then you can again hire an attorney and try and go back to change visitation. This is so wrong, it has to be fixed, and that is my goal.
I hope to get so many people on board with the fact that this needs to be changed, that legislatures in Texas will not be able to ignore this problem. I have already experienced this myself, and there is nothing that can be done about it right now. One of my friends who lives in the same city has had this happen 32, yes 32 times, in three years. He has that many separate case numbers with the local police, and then and only then did they file this felony charge against the offender.

I have also discovered that a Texas State Representative has tried to get this issue addressed, but we still have nothing in place to fix this. The representative is Mr. James White, and he is out of Houston. He proposed a house bill 3883, which would be wonderful to see passed. I have emailed him, and urge those that are really on board to email your local representative, or our state senators as well (Ted Cruz and John Cornyn) Thank you for all the support, the bill is here to read
