We citizens of Darjeeling Dooars and Terai and also the Gorkha citizens of India living across the nation and abroad along with the friends and supporters of our community bring the below concern to your notice.

My constitution grants me the Right to equality(Arts. 14-18) which in turn includes equality before the law. However, in Darjeeling area, we see the misuse of Judiciary power. We, as citizens of this country, have the utmost respect for our country, and when these misuses of the judiciary to serve the autocratic few is destroying the fabric of our great nation.
We Demand the formation of Gorkhaland as the 30th state of India in for recognition of our national identity and also to preserve our Cultural and Educational Rights (Arts. 29-30). I am sure you are already aware of the benefits of forming this new state its validity and potential as this is one of the oldest demands in the nation. We see the need to correct an error made in the past, and we consider you will make this state the permanent political solution for the Gorkhas. If you require documents regarding the same, we will be happy to provide. Any person who has raised the voice for this constitutional demand are targetted in West Bengal. Any person who speaks against the language and cultural imposition by the state government of our community is victimized.

Today, 17th July, two years ago, suppression by power started with the death of two people in Darjeeling in police firing on protest against Language imposition. This has resulted in 11 death more than 500 people jailed and more than 10000 displaced. The population of approximately 15 lacks living in fear psychosis in the area. We have witnessed judiciary used as play dough to be molded and used in any way that suits the oppressor.

A lady is beaten brutally kicked and refused medical treatment.
A child of 3yrs is jailed with a mother just because she was out looking for her husband.
A Human rights activist who helped register police complain and file a petition to human rights organizations arrested on charges of arson.
A person writing in favor of the cause and against atrocities on the people jailed.
Attachment of family property of people associated with the political party that is the NDA Alliance.this has left many families homeless and interrupted schools for children and left senior citizen on the street
these are just a few such incidents details of individual cases will be provided if required.
In Darjeeling, West Bengal, you don't have to be a criminal to be jailed you have to raise a voice, and they will arrest you on false charges and make sure you suffer the maximum possible through the judicial process. The judiciary and police have been in place to protect us, but here it is used to suppress the collective voice of citizens. Right to freedom (Arts19-22) Right against exploitation (Arts. 23-24) and Right to constitutional remedies (Arts.32-35) are all missing.

Bjp has represented Darjeeling for the last two terms in the parliament. During the previous tenure, Mr. SS Ahluwalia was our MP. In spite of all the atrocities in the area, no substantial action was taken. He did not even visit the constituency. The citizens and Voters of Darjeeling constituency have shown our faith in the capability of our Prime Minister Shri. Narendra Damodardas Modi. We believe that he is one prime mister who has made the difficult but necessary changes required in our nation. We have full faith in his vision and think he will solve our problem. We are also very Glad at the appointment of Shri. Amit Shah in the office of Minister of home affairs and are assured we will see positive results With faith in your leadership. We have elected Mr. Raju Bista with a considerable margin of approximately four lack votes. As a citizen of the constituency are now saddened to note that post-election results have been declared the conditions are getting worse. Mr. RP Waiba an 80-year-old arrested and beaten by police. The spokesperson of your alliance partner Mr. BP Bjgain along with other members of his party are in judicial custody. A poet and political analyst have been accused of arms act. As we see it as citizens, we have been jailed for raising the right questions and being a pivotal part of the election campaign. We as a community respect the law and understand the necessity as well as the benefit of the judiciary and police, however, in West Bengal; it has become a piece of party machinery from state machinery.
We request you to take necessary action immediately and release our people and protect the rights of the citizens in the area. These oppressions is not a question of political caders; this is a case of killing the voice of the citizens of India. When local tyranny is not stopped that tyrant will in time, destroy the nation. Take the necessary action and protect the democratic thread of our great country.
