The Issue

As a social work student deeply invested in the wellbeing and safety of young individuals, I have seen firsthand how crucial it is to protect 16- and 17-year-olds from exploitation and power imbalances that can arise in relationships with significantly older adults. It is alarming that, in the eyes of the law, a 16-year-old can legally engage in sexual activity with someone much older simply because they have reached the age of consent. This potential for exploitation is a serious loophole in our current legal framework that needs urgent attention.

Current UK legislation, under the Sexual Offences Act 2003, allows young people aged 16 and 17 to consent to sexual activity. However, it fails to take into account the unique vulnerabilities of teenagers and does not offer additional protection against adults who are significantly older. This group is still at risk of grooming, coercion, and other forms of exploitation despite being legally allowed to consent to sexual activities.

We propose a necessary amendment to the Sexual Offences Act 2003 to introduce a new age-gap provision specifically for 16- and 17-year-olds. Our proposal suggests that sexual activity should only be lawful if the older individual is within a close-in-age range, such as no more than three years older. This amendment would provide a legal safeguard against predation by significantly older individuals and help ensure that relationships involving young people of this age are consensual, equitable, and free from undue influence.

We can draw from successful models in other countries where age-gap laws have been introduced to better protect young people while maintaining their autonomy. Such legislations often include protective measures focused on the interests of young individuals, acknowledging their capacity for making decisions while guarding against exploitative dynamics.

Our goal is to ensure that 16- and 17-year-olds are protected in a manner that the original age of consent laws intended but currently fail to achieve. These measures would help foster a safer environment that enables young people to grow and develop in healthy relationships.

This petition urges the UK Government to review and amend the Sexual Offences Act 2003. It is important for our laws to evolve as we gain more understanding of social issues related to youth and consent.
