Amend the Raise the Age Act for Justice in Albany, NY

The Issue

My heart is heavy as I write this. My nephew, Quadair Hoffler, was brutally taken from us in a senseless act of violence. Our family is shattered, and our community remains on edge. This tragedy has not only left an aching void in our hearts but has also highlighted a crucial issue in our justice system that desperately needs reform.

The Raise the Age Act, implemented in New York in 2017, was designed with positive intentions to ensure juveniles are treated appropriately within the justice system. While this legislation aims to protect youth from the harsh realities of adult incarceration, it has inadvertently created loopholes that impede justice for victims in cases involving serious crimes perpetrated by minors.

Quadair’s case stands as a stark reminder of these gaps. The individuals involved in his murder exploited these loopholes, evading the full extent of accountability due to their age. It is vital that while we aim to rehabilitate minors, we also uphold stringent measures for cases of extreme violence, ensuring they are addressed with the seriousness they warrant.

Current statistics reveal a concerning trend: violent crimes involving youth offenders in New York have risen, and justice remains elusive for many bereaved families. The system, as it stands, fails to adequately balance rehabilitation with justice for victims. According to a report by the Division of Criminal Justice Services, there's been a noticeable increase in heinous offenses by minors since the enactment of the law.

We call upon the New York State Legislature to revisit and amend the Raise the Age Act. Our proposal includes establishing clearer guidelines for exceptions when dealing with violent crimes, ensuring that perpetrators like those who harmed Quadair are held appropriately accountable. By doing so, we can honor my nephew’s memory and prevent future injustices.
