I lost my beloved brother Andy suddenly on 13th July 2023. In the wake of this horrendous heartbreaking tragedy, my family and I agreed that I would serve as the representative at his inquest. It was then we discovered the shocking truth - our mother, who my brother had always designated as his next of kin, wasn't legally recognised. Instead, it was his ex-partner who would legally become his next of kin. Despite them not being together for many years or ever being married. We needed approval from his ex-partner before I could continue being the point of contact and obtain the confidential information regarding my brother's inquest. This situation is not only morally wrong but also against my brother's wishes. This law will cause so much stress and complications for many grieving families. We are currently still going through the process of the inquest, which is the hardest thing I've ever had to face in my life. The final inquest will be in March 2024 and I'm going to keep fighting and doing everything I can to get justice for my brother regarding the circumstances that led to his death. 

Currently, if a single person passes away, their child is considered next of kin by law. If that child is underage, then the other parent becomes next of kin regardless of their relationship status or history with the deceased parent. This law disregards personal relationships and individual wishes in favor of strict legal definitions.

We believe this law needs to be amended to consider deceased parents as next in line for next-of-kin status when an underage child is involved. Such an amendment would respect both familial bonds and personal preferences while ensuring fair treatment during such difficult times.

Our experience has shown us how upsetting and stressful it can be when laws do not align with personal desires or moral standards. We hope that by sharing our story and advocating for change, others will not have to endure any unnecessary suffering following the death of their loved one's.
