The Issue

The Laws under the Immigration Act 1971 include exemptions incorporated under the European Convention on Human Rights (ECHR)  that many forgein males are taking advantage of. This petition is for the Government to debate and make amendments of the particular sections that prevent the Home Office from deporting male illegal / legal immigrants. The reason for this is that we are over populated with Male Immigrants that not only put a strain on our Country's finances but have been the source of many sexual and violent attacks on women and children.

The European Convention on Human Rights (ECHR) and UK Borders Act 2007 both include wording and exemptions refered to under Section 33 and Section 34 that contradict the safety of Citizens.  As an example Section 34 (timing) part 2:

(2)A deportation order may not be made under section 32(5) while an appeal or further appeal against the conviction or sentence by reference to which the order is to be made— (a)has been instituted and neither withdrawn nor determined, or(b)could be brought.

This prevents from a dangerous individual from being deported even when convicted of a crime such as entering the Country Illegally. Solicitors can use these simple aspects of the Law to in danger women and children.  This needs to be addressed.

Article 33 of the Refugee Convention (Non-Refoulement) also contains wording that prevents deportation of dangerous males. Section 33 (1)  prohibits states from expelling or returning ("refouling") a refugee to a territory where their life or freedom is threatened however, blocks the use of Section 33 (2) contains a strict exception allowing deportation if the refugee constitutes a danger to the security or community of the host country.

These sections need to be discussed and amended to allow the Home Office a fairer trial and the Secretary of State to be able to make an impartial decision not tailored by protective laws for the criminal/ immigrant/ refugee.
