Thank you for contacting me about women’s access to healthcare. I appreciate you taking the time to make me aware of your concerns on this important matter.
A woman, in consultation with her doctor, should be empowered to make her own medical decisions. This includes deciding whether to have an abortion, a normal and complex decision that a large majority of Americans believe should be legal. That is why I have worked to protect a woman’s right to make her own choices regarding her reproductive health, including not only on choosing to have an abortion, but also on using contraceptive, including emergency contraception, and advanced reproductive technologies, such as in vitro fertilization. No woman, and certainly no child, should be forced to bear a child against their will, particularly when doing so will compromise their health, or in horrific cases of rape or incest.
In a Nation with a growing maternal mortality crisis, and without accessible affordable healthcare or childcare or universal paid leave, forcing births on millions of people – even when the mother’s life could be at risk – is particularly cruel. Millions of American families—including my own—have relied on Roe v. Wade, and 70 percent of Americans believe it should remain the law of the land. Unfortunately, an ultra-conservative majority of the Supreme Court voted to overturn Roe v. Wade and nearly 50 years of established precedent. This horrifying and extremist decision confirms what we have known all along – reproductive rights, and all fundamental unenumerated constitutional rights, including the right to contraception and gay marriage – are under the greatest threat they have ever been by a small group of far-right Justices. The Supreme Court of the United States and the Justices who claimed Roe was ‘settled law,’ but then turned around and ruled otherwise, will—as Justice Sotomayor said—‘struggle to survive the stench’ of this extreme decision.
Congress must act quickly and decisively to codify Roe and enshrine the right of an individual to make their own healthcare choices in privacy, without unnecessary interference. That is why I helped Senator Richard Blumenthal of Connecticut introduce S.1975, the Women’s Health Protection Act of 2021 (WHPA) on June 8, 2021. Our bill would formally codify Roe v. Wade into law, prevent States from enacting loophole abortion tactics intended to make accessing an abortion more difficult and safeguard the ability of healthcare providers to offer reproductive healthcare services. I also voted to pass H.R.3755, the House version of WHPA, and S. 4132, the updated Women’s Health Protection Act of 2022. Unfortunately, this critical legislation did not advance in the Senate. Please be assured that I will never stop working to codify Roe v. Wade into law to protect reproductive freedom for all Americans.
I strongly opposed and voted against confirming Justices Neil Gorsuch, Brett Kavanaugh and Amy Coney Barrett because I was feared that all three would join a majority in voting, for the first time in the Supreme Court’s history, to eliminate an existing constitutional right and liberty for millions of Americans. And that is precisely what these three extreme conservative Justices did, joining the other three far-right Supreme Court Justices to rip away the right of women to access safe and legal abortion healthcare services, jeopardizing the health and safety of millions of women and giving a green light to States to enact laws that throw doctors and women in prison for exercising what was once a constitutional right for nearly a half a century.
The harms of overturning Roe will disproportionally hurt low-income Americans who do not have the resources to seek abortion care in another State. In addition, in States who choose to ban access to basic care, pregnant individuals who require emergency care for life-threatening medical conditions such as an ectopic pregnancy, miscarriage or sepsis must wait hours in agony, risking death, as doctors consult with hospital lawyers before administering life-saving care in the form of a medically necessary abortion. I strongly oppose any State law requiring doctors to knowingly violate their Hippocratic oaths and place their patients in danger of serious illness or death.
As your Senator, I am committed to defending a woman’s right to make her own decisions regarding her body and her health, in consultation with her doctor, without improper interference from the government. This includes protecting every American’s constitutional right and freedom to access legal abortion services and contraceptives. Please be assured that I will keep working to convince all of my colleagues in the Senate that we must codify Roe v. Wade into law so that every American has equal access to basic, necessary healthcare – regardless of which State they live in, the color of their skin or the size of their income. I will also do everything in my power to ensure that Illinois remains a safe haven for all women seeking reproductive care.
