

Amend the 50/50 custody law in Florida
The Issue
I am the mother of autistic twin boys, and our lives have been turned upside down by a recent court decision. Despite presenting over 120 pieces of evidence during a custody dispute demonstrating that a 50/50 time-sharing arrangement with their father was not in their best interests, the judge awarded equal time-sharing. This decision was based on the lack of provisions in the current Florida law to protect children with disabilities.
The current 50/50 custody law in Florida does not take into account the unique needs of children with disabilities, particularly those with autism, who often require a stable home environment. Forcing autistic children into a 50/50 custody arrangement can have detrimental effects on their development and well-being. Their need for consistency, routine, and a stable environment cannot be overstated. We've seen physical, emotional, and health neglect arise from this arrangement in my family, yet the court's hands were tied by an outdated law.
According to the CDC, about 1 in 44 children in the United States are diagnosed with autism spectrum disorder (ASD). This represents a significant portion of children who may face similar challenges in custody arrangements. Additionally, studies show that children with autism benefit greatly from predictable environments and consistent caregiving.
It is imperative to amend the Florida 50/50 custody law to require courts to thoroughly consider the specific needs of children with disabilities when making custody and time-sharing determinations. Judges should be equipped to make decisions based on a child’s best interest, including their health, safety, and emotional wellbeing, rather than adhere to rigid laws that don’t accommodate the unique circumstances of every child.
This petition is a call to action for legislators to prioritize the needs of children with disabilities in custody laws. By amending this law, we can ensure that children with disabilities receive the stability and protection they deserve.
