Amend New York State Law to Classify At Fault Traffic Fatalities as Manslaughter

The Issue

My father, a commuter cyclist, was tragically killed by a distracted driver who violated numerous traffic rules including failing to yield and failing to signal. The driver faced only a minor traffic violation fine and continues to drive today. This is not just my personal tragedy; it's a systemic issue that needs immediate attention.

In New York State, when drivers are 100% at fault for killing pedestrians or cyclists, they often escape with minor penalties. This lack of serious consequences does not reflect the gravity of their actions or the loss suffered by families like mine.

According to the National Highway Traffic Safety Administration (NHTSA), in 2018 alone there were 6,283 pedestrian deaths and 857 bicyclist deaths due to motor vehicle crashes in the United States. Many of these fatalities occurred because drivers failed to observe basic traffic rules.

We propose amending New York State law such that if a car driver is found entirely at fault for causing fatal accidents involving pedestrians or cyclists, it should be classified as manslaughter. This change will ensure justice for victims' families and serve as a deterrent against reckless driving behavior.
