AMEND CHAPTER 11b of The Charter of Rights and Freedoms- Canada
The Issue
This is a call to action for the Government of Canada to amend and put an asterisk on:
Chapter 11b of the Charter of Rights and Freedoms: “any person charged with an offense has the right to be tried within a reasonable time.” This Right applies to ALL criminals and ALL crimes, therefore ALL Canadians are recklessly affected by this issue.
Under the current laws, dangerous criminals are allowed to go free due to perilous court delays. Canadians need to be wary that regardless of incriminating evidence, the number of charges, witnesses and/or egregious nature of the crimes, criminals are not being prosecuted and are excused of all wrong doing. This is not for lack of guilt, but simply based on technicality. Criminal rights have superiority over victim rights. Criminals are allowed to go free in the community. Canadians are not safe.
Whilst efficacy in court proceedings is important for both the victim and the accused, it should not out weigh the human need for safety and justice.
Chapter 11b needs to be amended to only include crimes that are less severe in nature or do not physically endanger Canadian citizens. The justice system needs steadfast reform, as it is currently failing: redundant, dangerous and abhorrently retraumatizing for victims.
Please stand with us as we directly address our governments and work with them to bring awareness of these dire issues, encourage open and equitable discussions and appropriately allocate resources to amend the laws that gravely harm our citizens. We want a safe, just and fair Canada for everyone.
