The Issue

What is happening inside the commercial trucking industry today is not hiding in the dark. It is sitting in broad daylight, covered up by safety slogans and corporate public relations that blind the public to what is really going on behind the scenes. The everyday person is led to believe that the FMCSA Clearinghouse is simply a fair system designed to make our highways safe. But on the ground, that system has become a corporate trap. Companies market themselves as “SAP-friendly” to appear as though they believe in second chances. In my observation, the carrier does not necessarily let the driver go when freight is slow. Instead, drivers may be fired at will. It often appears that the stated reason is that the carrier’s insurance provider will not allow high-risk employees to remain covered under the policy. At the same time, I have found that SAP-friendly carriers are not fulfilling their obligation to assist with rebuilding the driver’s redemption plan assigned by the SAP counselor. The SAP counselor provides the recommendations the driver needs to clear their name, yet the carrier may fail to provide the required follow-up support and testing. This concern has existed since the Clearinghouse was implemented in 2020. This dissertation presents a structural, micro-economic, and administrative analysis of the institutional defects inherent within the Federal Motor Carrier Safety Administration (FMCSA) Drug and Alcohol Clearinghouse framework. It examines how a federally mandated highway safety mechanism has been systematically co-opted by commercial motor carriers as a tool for artificial capacity inflation, corporate insurance premium manipulation, and predatory labor extraction—a cycle conceptualized here as what I call the human logistics “Pump and Dump” paradigm. Utilizing qualitative field data from senior recruitment pipelines, independent Third-Party Consortium workflows, and Entry-Level Driver Training (ELDT) programs, this study demonstrates that stripping commercial operators of testing autonomy produces a severe asymmetry of regulatory accountability. The monograph concludes with a series of actionable, empirical policy interventions designed to restore independent rehabilitation pathways, enforce institutional HIPAA-compliant data symmetry, and stabilize the Home economic supply chain architecture. Financial Speculation Paradigms in Human Capital Logistics. Operating identically to the highly manipulative, illegal asset-building and forced liquidation operations observed within speculative equity and cryptocurrency markets, predatory carriers utilize the Return-to-Duty (RTD) framework for asset hoarding. “SAP-friendly” fleets mass-recruit second-chance drivers under a fraudulent banner of rehabilitation to artificially inflate their corporate fleet capacity, satisfy short-term shipping volumes, and secure lucrative enterprise freight contracts. Once maximum, low-wage labor is extracted under highly oppressive conditions, the carrier executes a forced liquidation of the human asset the moment corporate capacity demands shift. Crucially, the carrier deliberately lets the driver’s “time validity” clock expire, failing to administer mandated follow-up testing schedules. The driver is then terminated and falsely reported to the Clearinghouse as “non-compliant.” This loop allows the carrier to justify high premium extractions, avoid corporate liability, pocket processing fees, and force the driver to reset their entire multi-year financial and testing timeline from absolute zero—reducing the path of building a sustainable life for the redeeming driver, into an impossible chase for flying bubbles. Proposed Remedies 1. Complete Separation of RTD/Follow Up Oversight: Relieve the motor carrier of all authority to manage, sponsor, or hold power over a driver’s follow-up drug and alcohol sequence. Transfer some of this administrative tracking to independent Consortium/Third-Party Administrators (CTPAs), give drivers the full autonomous legal responsibility to protect and clear their own records directly. If the carrier is not abiding by the sap counselors recommendations in an absolute timely manner, so that time volatility does not discourage the unemployment of the driver and insurance providers disarray. 2. Mandatory Progress Portability: Enforce a permanent, electronic pipeline within the Clearinghouse database ensuring that all completed, observed negative drug drops seamlessly transfer from employer to employer, preventing carriers from wiping out a driver’s rehabilitation progress upon termination. 3. Fraudulent Termination Mitigation: Implement a mandatory federal audit trigger requiring any carrier that terminates a second-chance driver to present timestamped, verified communications with the driver’s independent CTPA, eliminating the practice of fabricating compliance failure to mask insurance arbitrage. 4. If a carrier perceives itself as SAP-friendly, it should be closely monitored with appropriate HIPAA processes to ensure it fulfills its federally appointed duties as stated in the FMCSR regulations of the drug and alcohol procedures. These laws clearly state that nobody is at-fault, but the convicted driver. Moreover, the carriers and administrating body of specimen collectors are given the Mistake-Free card when they are matriculating false operations without penalty, because the federal government has given consent to this fascist/draconian massacre. The Clearinghouse is clearly not in the favor of the intended recipient of rehabilitational fulfillment. By signing this petition, you are advocating for a fair system where individuals are judged based on their capacity to change and improve, not solely on past mistakes. Let us foster a supportive environment where second chance drivers are given the tools they need to succeed and become responsible, law-abiding drivers once again. Your signature counts in urging policymakers to create a process for follow-up testing and constructive rehabilitation for these individuals. Please sign the petition to make a change that benefits society as a whole.
