The Issue

I am writing to share my deeply personal struggle with our current justice system in South Dakota, a state where redemption and second chances should be part of our community values. My story is one of growth, responsibility, and the desire to contribute positively to society; however, my felony conviction has proven to be a seemingly insurmountable barrier to a full reintegration into my community.

Having made mistakes in the past, I faced the consequences, served my time, and have since dedicated myself to bettering my life and those around me. Despite this transformation and having shown significant advancement in areas like employment, education, and civic responsibility, my criminal record remains a permanent shadow, largely because South Dakota does not currently have a comprehensive system that allows individuals with a felony to become eligible for a pardon or at least, one that isn't almost impossible to obtain.

The inability to expunge or seek a pardon for a felony without a clear legislative pathway penalizes those who have done the hard work to rehabilitate themselves. Imagine the hundreds of citizens just like me, who, despite contributing positively to their communities, are held back from reaching their full potential. According to the Bureau of Justice Statistics, nearly 1 in 3 American adults have a criminal record. Without innovative legislative action, these citizens continue to face barriers in securing employment, housing, and fully participating in society.

I am advocating for a reform in our state's law to establish a structured and fair approach for individuals with different types of felonies to apply for pardons. This could include setting a clear timeframe and criteria demonstrating rehabilitation, such as maintaining consistent employment, community service, and continued learning. Such a reform needs to be rooted in accountability and evidence of true personal growth and societal contribution.

Implementing this change would not just benefit individuals like myself, but the entire community. It fosters a sense of fairness, promotes economic stability by reintegrating capable individuals into the workforce, and decreases recidivism as people are motivated by the possibility of a clean slate. Moreover, it upholds the belief in personal transformation — a principle this nation was built upon.
