On 18th of March 2021, most of the creditors are receiving the email as follow: 

Thank you for your patience as we continue to progress with the regulatory process to restructure our business affairs after submitting an application for a debt restructuring plan to the High Court of Kuala Lumpur, Malaysia. We are pleased to formally inform you that the restructuring process is progressing as planned, and we are now inviting all scheme creditors, including passengers, to participate in the proof of debt (“POD”) exercise.

For the purpose of the POD, you are required to prove your debts. To facilitate this process, we are sharing with you a document that contains a letter and the POD form that explains the requirements of the POD exercise. Each passenger is also assigned a unique E-filing ID which will help us to organize the submissions.

Please complete the POD form and provide all supporting documents, and return the complete pack of documents via hard copy and email by 7 April. You may find more information and details of the POD here.

 We, as customers of Air Asia X Berhad who have not yet been refunded would like to get further restatement and justification of this Proof of Debt exercise in an understandable and concise:

• We demand to be CLEARLY INFORMED how the Debt Restructuring Process and Proof of Debt affect our refund process
  •  Particularly, please DISCLOSE the Repayment Plan when Air Asia X Berhad is in liquidation or bankruptcy in the future
• We demand to be CLEARLY INFORMED the reason why we need to submit the proof of debt even though Air Asia X Berhad has the record of our credit account.
  • In particular, please EXPLAIN clearly what you imply in the statement below: 
  • In the event the claim made in your POD Form is inconsistent with AAX Group’s records and/or is
    not agreed to by AAX Group, the amount to be admitted as owing to you for the purpose of the
    Court convened meetings of creditors to be held will be determined by an independent adjudicator
    and/or the Chairman of the CCM (or his alternate).
• We demand the FULL REFUND of our purchase regardless of whether Air Asia X Berhad might be in liquidation or bankruptcy in the foreseeable future.
• We demand the extension of dateline to submit the POD and any cost associated with it to be COVERED by Air Asia X Berhad

In the event that we could not come to an agreement on the above issues, we shall not submit the POD.
