Stop parent/family alienation with a disabled adult child after 18th birthday.
The Issue
This petition will help my daughter who was withheld by the biological father three weeks after her 18th birthday on his visitation weekend. He was upset about a conversation to modify my 15 year old support order. The disabled adult child did not have guardianship established "yet" due to Florida State Laws, that require the caregiver/family member to establish guardianship "after" the 18th birthday. Due this fact, he was able to alienate her with no repercussion from the police, courts or visitation orders. In addition there is no intervention by the police or the courts.Unfortunately, it is more convenient for the father's lifestyle to ignore my daughters documented disability needs and required structure and assistance. Without the guardianship in place she is treated as a non-disabled adult with little protection such as being left home alone. The child is not protected from situations/choices like riding with someone who has a known sleeping disorder and is in danger of crashing with the disable adult child in the car, being protected from those who use drugs and have harmful backgrounds. This vulnerable adult population are at risk while the fight in court is being filed and process. As individuals are awaiting filing for a court date, the disable child adult is not protected from any of the necessary laws. My disable adult child has been alienated and due to her being easily influenced with an intellectual disability, the father is intentionally disconnecting the child from me to continue an emotional warfare. There is no communication between the adults and her medical updates are even being kept secret intentionally. I am not physically seeing my child for weeks and months due to this status and there is denigration with no merit.This is a female disable adult child who needs her mother still in her life. She is being alienated not only from her mother/caregiver of 18 years with no intervention, but the entire maternal family, friends, community activities and volunteerism that help sustained the disable adult child's life. A visitation order and strict laws need to be put in place to make sure the disabled adult children have access to both parents/caregivers and maintain a consistent schedule to enjoy the life and relations she/he had before the 18th birthday. Current psychological evaluation and exams should be performed and mandatory for the parent/caregiver who has physical custody of the disabled adult as well "prior" to established guardianship approval.
