Abolish qualified immunity to end law enforcement and judicial corruption
The Issue
To the Congress of the United States and State Lawmakers:
We, the undersigned citizens, call for immediate legislative action to restore integrity, transparency, and civil rights to our justice system. A truly equal democracy requires that no individual—regardless of their title, badge, or position—is above the law.
Currently, the judicial doctrine of qualified immunity shields law enforcement officers and judicial employees from personal liability when they violate constitutional rights. Combined with internal self-investigation systems that allow departments to police themselves, victims of official misconduct are routinely denied justice, while bad actors face little to no consequences.
We stand united to demand meaningful statutory reform: abolish qualified immunity, create independent civilian oversight, and hold public officials strictly accountable under the law.
My Personal Story: Protected Abusers and Internal Cover-Ups
Over the past ten years, I survived multiple abusive relationships—only to find that the very officers sworn to protect me were actively violating my rights as a victim and protecting my abusers. When I sought help, law enforcement failed me. When I sought justice by filing complaints with oversight bodies—including POST training boards, state Attorneys General, and even federal authorities—the system closed ranks.
Every single complaint I filed was routed directly back to the very agency I was complaining about. There were no independent investigations, no explanations provided, and no transparency. Misconduct was brushed aside with a simple slap on the wrist, leaving me isolated and without legal recourse.
My experience is not an anomaly; it is proof of a broken system that allows law enforcement officers to police themselves. Qualified immunity and internal shield policies allow corrupt or biased officers to violate victims' rights without facing real consequences. We must abolish qualified immunity and create independent civilian oversight so that victims are protected, abusers are held accountable, and no police department can investigate its own wrongdoing.
Our Core Legislative Demands:
We urge our elected representatives to pass legislation that accomplishes the following three critical objectives:
1. Abolish Qualified Immunity:
Direct Civilian Action: Enact federal and state legislation that explicitly removes qualified immunity as a legal defense, ensuring civilians have the unencumbered statutory right under 42 U.S.C. § 1983 and state laws to sue individual officers directly in court for constitutional and civil rights violations. Equal Protection Under the Law: Hold government agents and public safety officials to the same legal standards of civil liability as ordinary citizens when their actions cause harm, excessive force, or wrongful detention.
2. Mandate Independent Civilian Oversight and End Self-Investigation:
Complete Operational Independence: Establish civilian-led oversight bodies completely separate from law enforcement agencies, municipal police departments, and internal affairs divisions.
Subpoena and Investigative Authority: Grant independent oversight bodies full statutory power to issue subpoenas, compel witness testimony, gather evidence, and conduct independent forensic investigations.
Prohibition of Self-Routing Complaints:
Legally prohibit state and federal oversight agencies (including POST boards and Attorneys General) from forwarding misconduct complaints back to the target agency for internal review.
Public Transparency: Guarantee that every complaint submitted receives a documented, independent case resolution, with written findings made accessible to the complainant and the public.
3. Enact Strict Criminal Penalties for Misconduct Under Color of Law:
Enhanced Penalties: Implement stricter criminal sentencing guidelines for law enforcement officers and judicial system employees who break the law while under oath or using official authority.
Special Prosecutorial Referrals: Require allegations of criminal conduct by public officials to be handled by independent special prosecutors rather than local district attorneys who work alongside those departments daily.
Why You Should Sign This Petition:
Constitutional rights mean nothing if they cannot be enforced. When law enforcement officers violate victims' rights, shield abusers, or abuse their authority without oversight, public trust collapses. Holding government officials accountable under the law deters misconduct, protects vulnerable victims, promotes high professional standards, and strengthens community safety.
