A Plea for Justice: Revisiting the Case of Robert Earl Council

This is a petition to The Alabama Court of Criminal Appeals and Judges on the 12th Judicial Circuit of Alabama.  

We are concerned citizens advocating for justice and equity, compelled to bring to the courts’ attention the urgent need to revisit the conviction of Robert Earl Council.  At just 20 years old, Mr. Council was convicted of capital murder and sentenced to life without parole—a conviction mired in racial inequity, judicial misconduct, and glaring conflicts of interest.

As courts entrusted with upholding the principles of justice, the Judges’ role in this matter is critical. They  have the authority and opportunity to ensure that the integrity of the judicial system is preserved by addressing the grave injustices that occurred during Mr. Council’s trial and appeals process.

Key Issues in the Case

Alarming discrepancies between the criminal appeal opinion and stated facts and the actual testimony elicited at trial. 

Racial Bias: A jury composed of 13 white jurors and only 1 Black juror raises serious questions about impartiality.

Conflict of Interest: Mr. Council’s court-appointed attorney was a personal friend of the victim, compromising the fairness of his defense.

Judicial Misconduct: Evidence suggests that critical facts were altered during the appeals process to uphold the conviction, despite the lack of credible evidence. 

These issues are not merely procedural errors; they represent a fundamental failure of the judicial system to deliver justice.

Judges are uniquely positioned to correct these wrongs. The legal system relies on courts to ensure that every citizen, regardless of race or background, receives a fair trial. By revisiting Mr. Council’s case, the courts can restore faith in the judicial process and demonstrate that Alabama is committed to justice and fairness.

We respectfully urge you: 

Correct the alarming discrepancies in the court of criminal appeals finding of fact. 

Reopen the Case: Allow for a thorough review of Mr. Council’s conviction, including an examination of the racial bias, conflict of interest, and judicial misconduct that tainted his trial.

Ensure Transparency: Provide a platform for all evidence to be fairly assessed and for the truth to come to light.

Advocate for Justice: Use your position to uphold the principles of fairness and equality that define our legal system.

This case is not just about Robert Earl Council. It is about the integrity of our courts and the trust of the people they serve. By addressing this matter,  the courts will not only bring justice to Mr. Council but also reaffirm the public’s confidence in our judicial system.
