Native American Sales Tax Exemption.

Choctaw Bay Indians

Jan 8, 2014 — Why is Florida not is step as other states regarding Native American Sales Tax Exemption and Use Tax Exemption. Most of these lands are Federal homestead quarters owned by Native Americans which are Restricted Lands. Public Law 280 states clearly the States lack of authority to Tax Native Americans. So why are they accepting Sales Tax from other states where Automobile purchases takes place? We need answers and the State Florida Revenue Department has not given a satisfactory answer. What Law or Treaty authorized by Congress allows them Sales Tax and Use Tax regarding Native Americans? http://en.wikipedia.org/wiki/Sales_taxes_in_the_United_States

Sales taxes, including those imposed by local governments, are generally administered at the state level. States imposing sales tax either impose the tax on retail sellers or impose it on retail buyers and require sellers to collect it. In either case, the seller files returns and remit the tax to the state.
