A new trial for Brett Bogle

The Issue

Brett Bogle has been on a serious end of injustice. Mr. Bogle has spent more than three decades on death row with an innocence claim. We, the undersigned, respectfully petition for a new trial for Brett Bogle, whose case was decided on February 15th 1993. We believe that the original trial was flawed due to the issues listed below. These factors have resulted in a miscarriage of justice, and we believe that Brett Bogle is innocent and deserves a fair and impartial trial to ensure that justice is served.

Reasons for Requesting a New Trial:

Reason 1:

New evidence DNA report from the victim`s fingernails:

No DNA from Brett Bogle was found under the victim’s fingernails. It was alleged in court that the victim scratched Mr. Bogle’s face. The DNA that was found underneath the fingernails belonged to two unknown males. It was alleged in court, that the victim had caused the wounds on Mr. Bogle’s face. The DNA evidence shows otherwise.

Reason 2:

The car accident:

 A few days before Mr. Bogle was arrested he was in a car accident. He ended up at the hospital. His face was beaten up, a punctured lung, and rib fractures. Evidence of Brett Bogle’s severe injuries, including photographs taken in the hospital, was not presented to the jury. The photographs from the hospital post his car accident and the photos from his arrest matches. The wounds were healing, and the wounds matched on both pictures. The pictures from the car accident were never presented in court. Witnesses stated in court that Mr. Bogle did not have any damage to his face before the murder. If the pictures had been included in the trail, this would have proven otherwise.

Reason 3:

A confession of another man:

 A confession had been written down on a note. The note was written by the prosecutor Karen Cox. The note stated that he had confessed and that someone needed to talk to him. This was never turned over before trial, which constitute as a Brady violation. Exculpatory evidence was not disclosed to the defence.

Reason 4:

Inadequate Legal Representation Ineffective Counsel:

The defence attorney failed to call crucial witnesses and did not introduce exonerating evidence. This case would most likely have had a very different outcome if this was included in the trail.

Reason 5:

Witness Testimony Issues

Perjury: Witnesses testified that Mr. Bogle had no visible injuries, which contradicts the evidence.

 

We believe that in the interest of justice, Brett Bogle deserves the opportunity to have his case re-examined in light of these concerns. A new trial would ensure that all relevant evidence is properly considered and that any errors in the original trial are rectified. Conclusion:

On September 13, 1991, Brett Bogle was wrongfully arrested and charged with first-degree murder, armed robbery, and other serious offenses. Just days before, on September 6, he had been involved in a car accident resulting in severe injuries, including broken ribs and a punctured lung. Despite evidence and witness statements contradicting the charges, he was convicted in a trial marred by errors, ineffective counsel, and the suppression of exonerating evidence. We, the undersigned, request that Mr. Bogle be granted a new trial to ensure a fair review of all evidence. We respectfully request that the court grants Brett Bogle a new trial so that justice can be properly served. We trust that the legal system will recognize the importance of fairness and due process in this matter.
