 On January 27, 2026, my son, Chris Fitzgerald II, was fatally shot in an apartment on the west side of Indianapolis.

 

While one person pulled the trigger, longtime friends made a choice: they fled. They left Chris to die, abandoning my son in his final moments and depriving him of urgently needed medical assistance. 

 

Eventually, a call was made for assistance, but only after critical, life-saving time had passed.

 

As of April 2026, more than 83 days later, no charges have been filed, little to no new information has been provided, no statements from authorities, and most crucially, a grieving family is without answers or closure.

 

The Legislative Gap

This case highlights a significant disparity in the Indiana legal system. Under current Indiana law, it is a crime to leave the scene of a minor vehicle accident, yet it is not a specific crime for a witness to flee the scene of a homicide, although immoral.

 

  • Indiana Code 9-26-1-1.1 mandates that drivers stay and provide "reasonable assistance" to the injured.

 

  • Currently, no equivalent mandate exists for witnesses of violent felonies, allowing individuals to abandon a dying victim without facing direct legal consequences for that abandonment.

The Mission of 33Forward

 

We are calling for the Indiana General Assembly to pass "Chris’ Law."

 

This legislation would mirror the intent of Good Samaritan frameworks like those in Florida and other states, creating a legal Duty to Report, ensuring that human life is afforded at least the same protections as property.

 

We Demand:

 

A Duty to Report: Establish a legal requirement for witnesses of a violent felony involving death or serious injury to contact emergency services and remain on-site if safe to do so.


Accountability for Abandonment: Provide law enforcement the authority to charge individuals who knowingly flee the scene of a violent crime instead of seeking aid for a victim.

 

Justice for Chris: We urge the Prosecutor’s office to use all existing statutes to thoroughly investigate the actions of those present and move forward with the case against the shooter.
