
🌳 Tree Ordinance Update:
There was promising progress after Thursday’s Township Committee meeting. Although the Committee is not planning to modify the current Tree Ordinance itself, they are working towards significant amendments to simplify the application process. While there still seems to be confusion, my understanding is that there will be two separate forms moving forward:
• Notification of Tree Replacement Exemption
• Application for Tree Removal
The Notification of Tree Replacement Exemption would no longer require township approval before removing an exempt tree or claiming an exemption. The tree could be removed without prior permission from the township, and residents would submit the notification form afterwards so the township can keep a count of removed trees in case the NJ DEP were to audit the township.
There was also lengthy discussion about whether the township should recommend that residents take photos of trees before removal in case the NJ DEP ever questions the exemptions. Regardless of what the Committee ultimately decides on that point, here is my personal recommendation based on conversations with residents regarding their previous experiences:
Protect yourselves and take pictures or have proofs before removing any tree even if it qualifies for an exemption. I have heard multiple stories of relentless calls to the NJ DEP on residents, as well as threats of fines from the Zoning Officer even for those with valid exemptions. Documentation and photos can help protect you if these situations arise.
Hopefully the Committee will finalize a resolution at the next meeting. Thank you to Mayor Kiernan and the Committee for consideration of the Land Use Board’s recommendations, as well as the residents’ concerns and working towards a more sensible and straightforward process.
