我們是一群關心香港學生成長及福祉的香港人,欲向 閣下表達近日 貴校教務會學生紀律委員會(下稱「紀委會」)開除學生關靖豐的學籍一事,對此深感不安,並覺此決定錯誤,將嚴重損害香港特區政府把香港發展成為「國際教育樞紐」的政策,同時違反國家治港方針,亦讓中大及當中決策者有被聯合國制裁之虞。我們期盼 閣下能恢復關同學學籍,予以畢業,獲得應有學歷。

同學就宏福苑大火發起聯署 後被中大紀委會聆訊

近日的公開資料顯示,紀委會是次開除學籍的決定,屬於去年12月1日關同學在被國安處被捕保釋後,向他展開紀律聆訊的結果。然而至今,關同學沒有被落案起訴,沒有被法庭定罪。這次同學被國安拘捕,源於去年11月26日發生震驚世界的宏福苑大火後,他發起聯署行動,要求政府部門就大火問責,成立獨立調查委員會,徹查潛在利益輸送情況,審視工程監管制度,以及確保妥善安置災民等。他的聯署行動發起不久,即被國安處拘捕,指其涉嫌煽動。

政府全盤接納同學的聯署訴求,顯示聯署行動正確

公開資料顯示,中大紀委會在拘捕事件後,隨即對關同學展開紀律聆訊,意味著紀委會認為關同學的聯署行動屬違紀之舉,但事實正好相反,他行動中提出的要求,得到政府全盤接納,尤其是特首李家超隨後宣布成立「獨立委員會」,徹查大火成因,審視樓宇維修施工安全監管人員(包括政府人員)的責任,以及樓宇維修工程涉及貪污圍標問題。這些跟進舉措,完全符合關同學的聯署要求,可見他做對了事。再者,他的行動出於關心社會、秉持公義、協助政府更好施政、鞏固政府管治基礎,不正是應該表揚而非違紀的行為嗎?

紀委會指控同學洩密欠證據,電郵內容不禮貌罪不致開除學籍

公開資料顯示,紀委會欠資料判斷他被捕情況,因而不作懲罰,但就指網絡上流傳他被紀委會聆訊的消息,是他洩密可致校譽受損,以及於他的電郵內容使用侮辱性字眼和聆訊時態度不禮貌,因此記過,連同他以往記過兩次,已合規開除其學籍。

我們認為,紀委會的決定欠公允。首先,關同學是否洩密只屬推斷,沒有作出調查以證實,而電郵字眼被指侮辱及不禮貎,這種錯誤是否達到了記過的高度?中大作為國際知名高等學府,培育學子時,遇上年青人犯錯,不是應該加以包容善教,而非置學子於死地嗎?他此前的兩次記過,都是他對公共政策表達不滿所致,包括拒絕打疫苗,以及在六四紀念日於燈柱貼上表達字句。這樣累積三次的記過,均與他的表達自由或行動自由有關,並非嚴重罪行或可鄙行為,中大給予記過及最終開除學籍,給人印象是政治凌駕教育。

紀委會決定違國家治港方針,恐惹國際制裁

當政府積極推動香港成為「國際教育樞紐」,打造「留學香港」品牌之際,中大以政治凌駕教育,對莘莘學子施以鐵拳而非諄誡,將嚴重打擊上述政策,拖香港發展的後腿,不符國家治港方針。

再者,國務院於2月10日發表了關於香港國安法實踐的白皮書,指出需要堅持尊重和保障人權,而國安的實踐「不追求絕對安全,或泛化安全」,那就是,不會一面倒政治掛帥,而今次中大紀委會開除學籍事件,顯然政治先行,違犯國家治港方針。同時,關同學的行動符合基本法內訂明適用於香港的《公民權利和政治權利國際公約》,中大卻對同學作出懲罰,恐被國際社會視為違反公約而令校譽盡毀,甚或招致國際社會制裁惡果,實非中大與香港之福。

籲請恢復關同學學籍,以圓滿畢業服務社會

因此,我們要求 閣下推翻紀委會決定,按理恢復關同學學籍,讓其順利畢業,好能把在中大所獲培育,造福未來社會。

We are a group of Hong Kong people concerned about the growth and well-being of Hong Kong students.  We wish to express our great worries regarding the recent expulsion of student Miles Kwan by the CUHK’s Senate Committee on Student Discipline ("Disciplinary Committee").  We see it as a wrong decision seriously undermining the Hong Kong SAR government's policy of developing Hong Kong into an "international education hub", violating the national policy of Hong Kong governance and even risking UN sanctions against CUHK and relevant decision-makers.  We urge for the reinstatement Miles Kwan's studentship for his graduation and attainment of the academic qualifications he deserves.

Miles Kwan summoned for a hearing by the Disciplinary Committee upon his launching a signature campaign regarding the fire at Wang Fuk Court 

Recent public information shows that the Disciplinary Committee's decision to expel Kwan from the university was a result of a disciplinary hearing held after 1st December last year when he was released on bail after arrest by the National Security Department.  However, Kwan has not been formally charged or convicted in court so far.  His arrest stemmed from his signature campaign on the devastating fire break-out at Hung Fook Court on November 26th last year, which shocked the world.  The petition demanded government accountability for the fire, the establishment of an independent inquiry committee for thorough investigation, probing into potential bribery and bid rigging, reviewing the building maintenance supervision system and ensuring proper support for the disaster victims.  Shortly after launching the signature campaign, Kwan was arrested by the National Security Department on suspicion of sedition.

The government's full acceptance of Kwan’s petition demands showing his action was correct

Public information shows that after the arrest, the Disciplinary Committee launched a disciplinary hearing against Kwan, implying that the committee considered his petition to be a violation of discipline.  However, the reality is quite the opposite: the demands he made were fully accepted by the government.  In particular, Chief Executive John Lee subsequently announced the establishment of an "Independent Committee" to thoroughly investigate the cause of the fire, examine the responsibilities (including government personnel) of the safety supervision for building maintenance works and investigate potential corruption and bid-rigging issues related to building maintenance. These follow-up measures fully comply with Kwan's petition demands, demonstrating that he did the right thing.  Moreover, his actions are out of his care for society’s well-being, public justice, helping the government for better overnance and consolidating government rule—shouldn't these be commendable actions, not violations of discipline?

The Disciplinary Committee's accusation of leaking information lacks evidence; the charge of impolite email content not grounds for expulsion

Public information shows that the Disciplinary Committee lacked information to determine the circumstances of Kwan’s arrest and therefore rendered no punishment.  But it mentioned information circulating online about the news of Kwan’s being heard by the Disciplinary Committee showed that Kwan leaked information, which could damage the university’s reputation.  The Committee also accused Kwan of using insulting words in his emails and his impolite attitude during the hearing.  Therefore, he was given a demerit.  Combined with his two previous demerits, he was expelled from the school in accordance with the university’s regulations.

We regard the Disciplinary Committee's decision of expulsion is unfair.  First, whether Kwan leaked information is merely speculation, without any investigation to confirm it.  Furthermore, does the use of insulting and disrespectful words in emails entail mistakes warranting a demerit?  As an internationally renowned institution, shouldn't CUHK be tolerant with patient guidance for youngsters who may have made mistakes, rather than putting them to fatal punishment?  His previous two demerits were for expressing dissatisfaction with public policy, including refusing vaccination and posting messages on lampposts about the June 4th incident.  These three accumulated demerits are all related to his freedom of expression or action, not serious crimes or despicable behavior.  CUHK's decisions to issue demerits that ended up with expulsion gives the impression that politics overrides education.

The Disciplinary Committee's decision violates the national policy on Hong Kong governance and may provoke international sanctions

As the government actively promotes Hong Kong as an "international education hub" and builds the "Study in Hong Kong" brand, CUHK's prioritization of politics over education and its use of iron fists instead of gentle admonitions against students impose a heavy blow on these policies, hinder Hong Kong's development and is inconsistent with China's policy on Hong Kong governance.

Moreover, the State Council issued a white paper on the implementation of the Hong Kong National Security Law on February 10, pointing out the need to uphold respect for and protection of human rights.  It also states that the practice of national security "does not pursue absolute security or pan-security", meaning no political dictation.  The recent expulsion of a student by the CUHK Disciplinary Committee clearly demonstrates political motives and violates the national policy on Hong Kong governance.  At the same time, Kwan’s actions comply with the International Covenant on Civil and Political Rights, which is applicable to Hong Kong and is enshrined in the Basic Law.  Thus CUHK's punishment of Kwan risks being seen by the international community as a violation of the covenant, potentially damaging CUHK’s reputation and even incurring international sanctions—a situation detrimental to both CUHK and Hong Kong.

We urge the restoration of Kwan’s studentship for his graduation with his subsequent service and contribution to the community

Therefore, we request for the overturn of the Disciplinary Committee's decision so as to restore Kwan’s studentship and allow him to graduate smoothly so that he can put the education he received at CUHK to benefit society.
