名古屋飛び降り巻き込み事件で命を奪われた娘の命を無駄にしないために未必の故意による殺人罪の適用を求める署名

署名活動の主旨

◆私たちのお願い
1.「未必の故意による殺人罪」での起訴
 接見での容疑者の供述および現場の状況を踏まえ、重過失致死罪ではなく「未必の故意による殺人罪」を適用して起訴すること。
2.危険性の認識に関する徹底捜査の継続
 容疑者が「覚えていない」という供述で逃げることを許さず、客観的状況からその危険性の認識を徹底的に証明すること。

◆ 事件概要
2026年7月19日午前1時ごろ、名古屋市中区栄5丁目の繁華街の歩道にて、友人と食事を終えて歩いていた娘・稲葉朋来(いなば ほうら・当時23歳)が、マンション11階から飛び降りた男に衝突され、出血性ショックにより命を奪われました。
何の落ち度もなく、ただ普通に歩道を歩いていた娘の未来が、一瞬にして奪われました。
現在、容疑者は「重過失致死容疑」で逮捕・送検され現在は4ヶ月の鑑定留置期間となっています。私たちはこの事件を単なる不注意による「事故」として終わらせることに到底納得がいきません。
今の法律や判例では、被告の主目的が「自死」にある場合、「他人を殺害する意思(殺意)まではなかった」と判断されやすく、未必の故意を立証して殺人罪を適用することには非常に高い法的なハードルが存在するのが現状です。

◆なぜ、未必の故意による殺人罪での起訴を求めるのか
現場の状況と接見での供述から、本件は過失ではなく「故意」で未必の故意による殺人罪に該当することが明らかです。
【現場の客観的事実】
現場は崖や橋の上ではなく、日中夜問わず多くの人が行き交う繁華街の歩道です。高い視認性:ベランダの真下は街灯で明るく照らされており、夜間でも下に人がいることを容易に認識できる環境でした。娘は突然歩道に出てきたわけではなく、落下地点の数メートル手前を事前に歩行しており、飛び降りたベランダから確実に認識できる状態でした。
高層階の選択:容疑者は自身が所有する複数物件の中で、最も高い11階を選んで飛び降りています。
落下地点:真下のダストボックスを越え、人通りのある歩道上に落下しています。
【接見で明らかになった容疑者の認識】
容疑者は警察の取調に対して「覚えていない」と答えていると聞いております。しかし、私たち遺族がこれまで行った3回の接見において、容疑者は私たちの問いかけに対し自らの認識・認容を明確に認めました。
遺族:「下に人がいようがいまいが、死のうが死なまいが構わないと思って飛び降りたのか」
⇒ 容疑者:「はい、そうです」
遺族:「飛び降りたら下にいる人に当たって大変なことになるかもと一瞬頭をよぎりつつも、『それどころじゃない、とにかく自分は今すぐ死にたいんだ』という気持ちが勝って飛んだのか」
⇒ 容疑者:「はい、そうです」
遺族:「飛び降りた時、下にうちの娘や友達が見えていたはずだ。それを思い出してくれ」
⇒ 容疑者:「はい、確認したと思います」


容疑者は、下に人がいることを確認し、衝突すれば大変なことになると予見しながら「それでも構わない」と容認して飛び降りています。

◆ 未必の故意とは
社会の皆様に知っていただきたいのは、現在の司法がこの事件を「単なる不注意による過失事故(重過失致死罪)」として片付けようとしている点です。
【重過失致死罪(過失)】:結果を予見できたのに「うっかり注意を怠った」事故。
【未必の故意による殺人罪(故意)】:「他人が死んでしまうかもしれない」と危険性を認識し、「それでも構わない」「死んでもいい」と受け入れて(認容して)行為に及ぶこと。
容疑者が「下に人がいることを確認し、被害者を含む第三者に衝突して生命を奪う可能性を認識しながら、それでもなお飛び降りる行為を選択した」という事実は、まさに法律が定める「未必の故意による殺人」の要件を完全に満たしています。

◆ 私たちの思い
これから先の人生、家族と笑顔で過ごす時間、叶えたい夢や輝く未来のすべてを理不尽な形で一瞬にして失った娘の恐怖と無念さを想うと、今も胸が引き裂かれる思いです。
本人がたとえ自殺目的で飛び降りたのだとしても、人通りの多い繁華街の高層階から飛び降りれば下にいる人に衝突し命を奪うことは容易に分かったはずであり、罪のない第三者を危険にさらすような行為が許されるはずはありません。
娘の死を単なる「不幸な事故」として終わらせず、司法には命の重さに正面から向き合ってほしいと切に願っています。

◆ 今、皆様にお願いしたいこと(朋来の死を、これからの社会を守る「光」にしたい)
現在、このような飛び降りによる巻き添え事案は、多くが「過失致死罪」や事故として処理されがちです。
しかし、もしこれが「ただの事故」として処理されてしまえば、「人が通る場所に飛び降りて誰かを巻き込んで殺しても、自殺目的であれば過失にしかならない」という悲惨な前例を社会に残してしまうことになります。娘は身勝手な絶望の身代わりになったのではありません。
親として、奪われた娘の未来のためにできる最後の仕事は、この裁判を通じて「人通りのある場所への飛び降りは他人を殺傷する危険な犯罪行為である」という正しい法規範と社会的警鐘を打ち立てることです。

娘の尊い命を、絶対に無駄死にはさせません。二度とこのような理不尽な形で大切な家族を奪われ、絶望の中で泣き寝入りする遺族を出さないために。そして、正義が正しく示される社会にするために。

Based on the suspect's statements during visitation and the situation at the scene, we demand that the suspect be indicted for "Murder by Willful Negligence" rather than Heavy Negligent Homicide.
Continued Thorough Investigation into Awareness of Danger

We urge authorities not to allow the suspect to escape liability through statements like "I don't remember," and to thoroughly prove their awareness of the danger based on objective evidence.
 
◆ Incident Overview

Around 1:00 AM on July 19, 2026, on a sidewalk in a busy commercial district in Sakae 5-chome, Naka-ku, Nagoya, our 23-year-old daughter, Hora Inaba, was walking after having dinner with friends when a man jumped from the 11th floor of a building and collided with her. She lost her life due to hemorrhagic shock.

Through no fault of her own—simply walking down a public sidewalk—her future was stolen in a single moment.

Currently, the suspect was arrested and handed over to prosecutors on suspicion of Heavy Negligent Homicide, and is presently under a 4-month mental evaluation detention. We cannot accept this incident being written off as a mere "accidental oversight."

Under current laws and legal precedents, when a defendant's primary purpose is suicide, courts tend to rule that "there was no intent to kill another person." As a result, proving eventual intent (willful negligence) and applying murder charges faces an extremely high legal threshold.

 
◆ Why We Demand Indictment for Murder by Willful Negligence

Given the facts at the scene and statements during visits, it is clear that this was not mere negligence, but an act of "intent" matching Murder by Willful Negligence.

【Objective Facts at the Scene】

Busy Pedestrian Area: The location was not a cliff or a bridge, but a sidewalk in a bustling commercial district frequented day and night.
High Visibility: The area directly beneath the balcony was brightly lit by streetlights, making it easy to see pedestrians even at night. Our daughter did not suddenly step onto the sidewalk; she had been walking a few meters prior to the impact point, clearly visible from the balcony.
Choice of High Floor: Out of multiple properties owned by the suspect, he chose the highest floor (the 11th floor) to jump from.
Landing Location: He jumped far enough to clear a trash container directly underneath, landing straight onto the populated sidewalk.
【Suspect’s Awareness Revealed During Visits】

We were told the suspect answered "I don't remember" during police interrogation. However, during three separate visits made by the grieving family, the suspect clearly acknowledged his awareness and acceptance when questioned:

Family: "Did you jump thinking you didn't care whether someone was down there or whether they lived or died?"

$\rightarrow$ Suspect: "Yes, that's correct."
Family: "Did you jump thinking for a moment that hitting someone below could cause terrible harm, but your desire to die right away was stronger?"

$\rightarrow$ Suspect: "Yes, that's correct."
Family: "When you jumped, you must have seen my daughter and her friends below. Please remember."

$\rightarrow$ Suspect: "Yes, I believe I checked."
The suspect confirmed people were below, foresaw that hitting someone would lead to catastrophic harm, yet accepted that risk and jumped anyway.

 
◆ What is "Willful Negligence" (Eventual Intent)?

We want the public to understand how current judicial practice threatens to process this incident as a simple careless accident (Heavy Negligent Homicide).

Heavy Negligent Homicide (Negligence): An accident where the outcome was foreseeable, but carelessness led to a failure in taking proper caution.
Murder by Willful Negligence (Intent): Recognizing the risk that "someone else might die," yet proceeding anyway with an attitude of "even if they die, so be it" (acceptance/reconciled intent).
The fact that the suspect checked for pedestrians below, recognized the risk of taking someone's life, and still chose to jump fully satisfies the legal requirements for "Murder by Willful Negligence."

 
◆ Our Thoughts

When we think of the terror and despair our daughter suffered—losing her future, her dreams, and her time with family in an instant—our hearts remain broken.

Even if a person's goal is suicide, jumping from a high floor in a crowded district makes it obvious that anyone below could be struck and killed. Endangering innocent bystanders in this manner must never be tolerated.

We desperately pray that justice directly addresses the value of human life, rather than treating our daughter's death as an "unfortunate accident."

 
◆ Our Request to the Public (Making Hora's Death a Light to Protect Future Society)

Currently, cases where bystanders are killed in jumping suicides are often handled merely as negligent homicide or tragic accidents.

However, if this continues to be treated as "just an accident," it sets a terrible precedent: that jumping into a populated area and killing someone results in nothing more than negligence as long as the intent was self-harm. Our daughter was not a substitute for someone's selfish despair.

As parents, the last duty we can perform for our daughter is to establish through this trial a legal norm and societal warning: jumping into a populated area is a dangerous criminal act that endangers others.

We will not let her precious life be lost in vain. To prevent other families from suffering such unreasonable loss and grieving in silence, and to ensure justice is served, we humbly ask for your signature and support in sharing this petition.

The collected signatures will be submitted to the Public Prosecutor's Office alongside our statement of opinion.
