หยุด พ.ร.บ. จีเอ็มโอ ก่อนซ้ำเติมเกษตรกรไทยให้ตายคาแผ่นดินเกิด
ทำไมแคมเปญรณรงค์นี้ถึงมีความสำคัญ
ตั้งแต่การปฏิวัติอุตสาหกรรมเขียว เกษตรกรไทยมีแต่จนลง เป็นทาสของผู้ผลิตปุ๋ยเคมีและทาสของเมล็ดพันธุ์ที่ง่อยเปลี้ยที่ผลิตลูกหลานต่อไปไม่ได้ สายพันธุ์ข้าวไทยจากหลายร้อยที่เหมาะสมกับภูมิประเทศเหลือปลูกกันไม่กี่สายพันธุ์ เท่านี้ก็เป็นเครื่องพิสูจน์ความฉิบหายของเกษตรกรรมไทยได้เป็นอย่างดี.
เกษตรกรที่ตระหนักรู้ต่างหลีกหนีไปหาแสงสว่างที่เรียกว่า เกษตรอินทรีย์ เริ่มบ่มเพาะพันธุ์ข้าวกันใหม่เพื่อเป็นทางรอดให้กับเกษตรกรรมไทย แต่แล้ว ครม. กลับอนุมัติ พ.ร.บ. ความปลอดภัยทางชีวภาพ หรือ พ.ร.บ. จีเอ็มโอ (GMO) เปิดทางให้การผลิตพืชดัดแปลงพันธุกรรมในสิ่งแวดล้อมแบบเปิดสามารถกระทำได้ แล้วต่อไปเราจะรักษาสายพันธุ์ท้องถิ่นไว้ได้อย่างไร เกษตรอินทรีย์ไม่ได้ดูแค่ไม่ใส่สารเคมี แต่มันจะมีค่าก็ต่อเมื่อมีสายพันธุ์ที่หลากหลายและสมบูรณ์
ส่วนผู้บริโภคนั้นคุณอาจจะคิดว่าไม่ได้รับผลกระทบโดยตรง เป็นเรื่องของเกษตรกรกับรัฐ แต่ในทางกลับกันผู้บริโภคต่างหากที่สุดท้ายจะเป็นผู้จ่ายต้นทุนด้วยสุขภาพของตนเองโดยไม่มีใครมาชดเชย
ในแง่กฎหมาย พ.ร.บ. มีประเด็นหลักสำคัญ 9 ประการที่ละเลยและเพิกเฉย เราจะปล่อยให้ไม่มีใครรับผิดชอบอย่างนั้นหรือ?

ประเด็นที่ 1 ร่างกฎหมายฉบับนี้ไม่ได้ยึดหลักความปลอดภัยไว้ก่อน (Pre-Cautionary Principle)
ประเด็นที่ 2 ร่างกฎหมายฉบับนี้ไม่ได้คำนึงผลกระทบด้านเศรษฐกิจและสังคม
ประเด็นที่ 3 ร่างกฎหมายฉบับนี้โดยหลักการคือการเปิดเสรีจีเอ็มโอ
ประเด็นที่ 4 ร่างกฎหมายฉบับนี้ไม่ได้บังคับให้ต้องทำการประเมินผลกระทบด้านสิ่งแวดล้อม
ประเด็นที่ 5 ร่างกฎหมายฉบับนี้ไม่ได้บังคับให้การขึ้นบัญชีปลดปล่อยสู่สิ่งแวดล้อมต้องทำการประเมินผลกระทบด้านสุขภาพ
ประเด็นที่ 6 ร่างกฎหมายฉบับนี้ไม่ได้กำหนดผู้รับผิดชอบความเสียหายที่เกิดจากจีเอ็มโอในบัญชีปลดปล่อยสู่สิ่งแวดล้อม
ประเด็นที่ 7 ร่างกฎหมายฉบับนี้ไม่มีบทคุ้มครองเกษตรกรที่พืชผลถูกจีเอ็มโอปนเปื้อน
ประเด็นที่ 8 ร่างกฎหมายฉบับนี้ไม่ได้ระบุหลักประกันทางการเงินกรณีเกิดความเสียหายจากจีเอ็มโอ
ประเด็นที่ 9 ร่างกฎหมายฉบับนี้ขาดการมีส่วนร่วมของภาคประชาชนอย่างรุนแรง
พ.ร.บ. นี้เพิ่งผ่าน ครม. ไปวันนี้ (25 พ.ย. 58) และกำลังเข้าสู่การพิจารณาของสภานิติบัญญัติแห่งชาติ (สนช.) โดยหวังว่าแคมเปญนี้เราจะสามารถ
กระตุ้นจิตสำนึกของความห่วงแหนแผ่นดินไทยของสมาชิก สนช. ให้ไม่อนุมัติตามอย่าง ครม. ได้
กระตุ้นการทำหน้าที่ของ สนช. เพื่อคนไทย ไม่ใช่นายทุนและผู้นำปากอย่างใจอย่าง
กระตุ้นไม่ให้คอรัปชั่นในรูปกฎหมายไม่เป็นธรรมเกิดขึ้น
และที่สำคัญที่สุด กระตุ้นให้คนไทยทุกคนรู้ว่าคุณกำหนดชะตาชีวิตของตัวคุณเองได้
เราทุกคนมีสิทธิ์ทำให้บ้านเมืองนี้ดีขึ้น ที่พูดกันว่าอยากช่วยเกษตรกรก็ต้องเริ่มกันตอนนี้ ไม่ต้องรอเป็นหน้าที่ของคนแต่งเครื่องแบบทหารหรือข้าราชการ การทำกฎหมายต้องมีผู้มีส่วนได้ส่วนเสียโดยตรงทั้ง เกษตรกร ผู้บริโภค รัฐบาล นักวิทยาศาสตร์ ฯลฯ เข้าร่วม ไม่เช่นนั้นหายนะก็จะเกิดขึ้นในระดับดีเอ็นเอของคนไทยทุกคน
Stop GMO bill before it kills Thai farmers on their own land
Since the Green Revolution, Thai farmers have become more and more impoverished, enslaved by manufacturers of chemical fertilisers and impotent seeds. From hundreds of species of rice that were indigenous to our land, we now have only a handful - proof of the impending doom on Thai agriculture.
Enlightened farmers have turned to organic farming, which is a safe and sustainable choice. They started cultivating different species of rice again for the survival of Thai agriculture, with the hope of improving their lives and becoming free from the economic slavery system. Organic agriculture also improves damaged environment and benefits consumers’ health.
However, our very own Cabinet recently approved the proposed Biological Safety Bill (the so-called GMO bill), which allows a free market and production of GMO crops. It legalises planting GMO crops in an open space, which means they can contaminate other local varieties. How are we then supposed to protect our diversity? Organic farming is not just about crops free from chemical composition, but also about promoting native plants and biodiversity of our land.
Some consumers may think that they won’t be directly affected by this GMO bill, that this is an issue between farmers and the government. But the fact is consumers will pay a high price with their health, and without compensation due to the unfair and irresponsible bill.
Nine reasons why we should protect our rights and stop this GMO bill together:
- This bill does not rely on pre-cautionary principle (which is used in Europe regarding the GMO issue)
- does not take into account potential social and economic impact
- essentially allows a commercial scale of GMOs and supports GMO free market without mentioning appropriate preventive measures and controls
- does not require any Environmental Social Impact Assessment
- does not require any health risk assessment before GMOs are allowed to be released into the environment
- does not identify a responsible party if damage occurs due to the listed GMO species
- does not protect farmers whose crops are contaminated by GMOs
- does not mention any financial protection for any possible damage caused by GMO species
- completely lacks public participation.
This GMO bill was approved by the Cabinet on Nov 25 and will next come under scrutiny by the solely-cabinet appointed National Legislative Assembly (NLA).
I hope that this petition will voice our concerns to the NLA members and encourage them to act with the best interest of Thai people in mind instead of serving some powerful corporations. Let’s tell them that we don’t support corruption in the form of unjust laws. Let’s ask them not to endorse this bill.
We have the power to write our own future in this country. A lot of Thai people said that they wanted to help poor farmers and here is their chance. No more waiting around for those in “power” to do it. Farmers, consumers, the government, scientists and other stakeholders need to be involved in the lawmaking process, otherwise all Thais will have to face the consequences.
