Mandate FMCSA to Enforce Detention Time and Brokerage Percentage Rate Regulations

The Issue

From personal experience, I've seen drivers wait up to an unnerving 8 hours to get loaded - all this without any detention time pay. Sometimes, when brokers or shippers do pay detention, it's a meager $25 per hour. This kind of scenario is simply unacceptable, it represents a grave injustice in our industry, and it is why we're calling for change.

It is high time that the Federal Motor Carrier Safety Administration (FMCSA) steps in to regulate both detention time and the percentage rates charged by brokers. Unchecked, these issues can pose serious challenges to the wellbeing and financial stability of drivers.

Given that the average truck driver works 70 hours per week (as reported by The American Trucking Associations), the unjust detention times just add additional unpaid hours to an already strenuous schedule.

As fairly as business-savvy brokers have the right to profit from their services, there needs to be a cap to ensure that their percentage rates are not exploitive. The goal should remain in facilitating a beneficial environment for both drivers and brokers - a win-win situation.

We urge the FMCSA to intervene and set standards that ensure every driver is fairly compensated for their time and every broker charges reasonable rates for their services.
