Jordanelle Corridor Owners Group 2012: Protest the Special Assessment Area Around the Jordanelle

The Issue

HERE WE GO AGAIN WITH ANOTHER PROPOSED ASSESSMENT OF PROPERTY AROUND THE JORDANELLE!!! 

NOTICE:  A law suit has been filed against Wasatch Fire District due to irregularities in creating an Assessment Area around the Jordanelle. 

The counsultant hired to conduct the official count of the protests submitted by the property owners in the proposed Assessment Area declared on December 5, 2012 that the protest of the Assessment Area was unsuccessful as only 49.58% of the 50% needed to stop the Assessment Area were submitted.  

The suit states that the Wasatch County Fire District held the protest votes for almost a month before delivering the protest votes to be officially counted.   During that time the Fire District was calling property owners who submitted protest of the Assessment Area and encouraging them to withdraw their protest as well as invalidating protest votes and not counting protest votes that were submitted until the fire district were able to reduce the number of protest votes below the 50% threshold needed to defeat the creation of the Assessment Area. 

The suit wishes to have the 4th District Court order the Assessment Area dissolved because sufficient protest votes were submitted to defeat the creation of the Assessment Area.   Additionally, the suit wants the court to acknowledge so many irregularities occurred during the process of creating the Assessment Area by Wasatch County that it also invalidates the creation of the Assessment Area.

Thank you to all who filed protests.  When we prevail on the law suit the Assessment Area will be dissolved and the double taxation will end.

 

After successfully defeating the assessment a year ago, Wasatch County is again trying to create an an assessment area around the Jordanelle for Fire Service. Additionally, the Utah State Legislature has twice addressed this exact issue and subsequently removed a municipality's ability to create Special Service Districts for Police, Fire and Ambulance service.

With complete disregard for the law the Utah State Legislature has created, Wasatch County is attempting to create a Special Assessment Area for exactly the same fire service they were prevented from creating by the legislature this year.

Wasatch County is proposing an assessment of 0.56 cents per $1000 of a property’s market value. This creates a burden on the owners of property in the Jordanelle area well beyond the assessment that the owners successfully defeated one year ago. Some quick math at these figures

$500,000 property would cost $280 per year twice what they were collecting before

$10,000,000 property would cost $5,600 per year for the exact fire service they were receiving for $145 per year prior to successfully defeating that assessment.

900 property owners in the Jordanelle Area should NOT have to pay an additional tax for fire protection service when (21,600) property owners of Wasatch County only pay for fire protection service through their annual property taxes. Because Wasatch County is doubling the previous assessment and in the case of multi-million dollar properties charging $1,000's for the same exact service we successfully protested last year has the potential to exceed $6 million dollars. It is especially important when the 900 property owners in the Jordanelle Area are asked to fund well over $6 million dollars in taxes in addition to their annual property taxes for fire protection service and the 21,600 property owners in Wasatch County are asked to fund $600,000 for fire protection service

So, we need you to please send another protest letter in. A copy of the protest letter is attached to this petition under the Petition Letter section.
