UPDATED 05 Oct 2012 to be clearer:
Originally we stated that Apple Inc should uphold the terms of cc-by-sa 2.0 license, but it is not clear under which licence they are using the OSM data, so we ask that Apple should state the license under which they use the OSM data and follow those licenses terms.
On the website here :
they give reference to OSM :
OpenStreetMap contributors, http://www.openstreetmap.org/
But this is not living up to the terms of the cc-by-sa license, or the ODBL license, it would be enough only if the OSM data was public domain.
Apple must state under which license they use this data and live up to the terms of that license. Generally that involves granting the users the same rights that they have received.
We assume that the license they are using is the cc-by-sa 2.0 creativecommons.org/licenses/by-sa/2.0/ but they should say exactly which one they are using.
If they are using the data under the ODBl license http://opendatacommons.org/licenses/odbl/ then they should state so and follow the terms as well.
Update: There is no way to just selectively use the data under PD from OSM:
