「少し冷たいですが、まだ生きてますよ」と亡くなった息子を渡してきた園長が不起訴に。
 

私たちの息子、涼空（りく）は、2022年7月30日、那覇市内の認可外保育施設　緑のすずの保育園で、一時預かり中に亡くなりました。

事故当日、園長は泣き止まないからという理由で、従業員にうつ伏せ寝を指示。その後、様子がおかしいと報告がありながらもお迎えまでの間、午睡チェックもせずに、数時間、薄暗い部屋の隅で息子を放置しました。

 

私（りくの母）がお迎えに行くと、15分待たされた挙句、亡くなった息子を抱き抱えて、少し冷たいですがまだ生きてますよ。と、目が開き、舌が固まって明らかに亡くなっている息子を私に渡しました。（その15分間は、亡くなった息子にシャワーを浴びさせ、オムツを替えていたと証言しています）

その後も、私が救急車を呼び、心肺蘇生法をしましたが、その間も園長は横で見ているだけで、温かい場所があるから生きていますよ。など、自分の責任を認めないような発言を繰り返しました。

慌てる様子もなく、全く誠意が感じられない対応は、その後も続き、私たちをさらに苦しめました。

 

この園は、 那覇市からの立入り調査で、「乳幼児突然死症候群の予防」「必要な保育従事者数の確保」など、こどもの命に関わる重要な項目で改善指導を受けていたにも関わらず、そのまま保育を行っており、事件の１ヶ月前にはこの園はおかしいと利用者からの通報もありました。他の利用者の方々からもひどい保育状況であったというお話しを聞いています。

そんな劣悪な保育がなされていた中で、息子の命が失われたにもかかわらず、先日、不起訴とされました。

こんなに残虐な事をしていながらも、全く罪に問われないのです。

 

私たちは、この判断が本当に適切だったのか、強い疑問を抱いています。乳児のうつ伏せ寝は重大な事故につながるリスクがあるとされており、保育現場では慎重な対応が求められています。

このままでは、同様の事故が再び起こることを防げないかもしれません。実際に、涼空が亡くなった後にも同じようなうつ伏せ寝での死亡事故が何件もあります。（起訴され、有罪判決が出ている事例もあります）

私たちが求めているのは、事実関係の再検証と、適切な法的判断、刑事処遇がなされることです。

具体的には、本件について再捜査を行い、保護責任者遺棄、もしくは保護責任者遺棄致死としての起訴を含めた適正な判断がなされることを求めます。

The director who handed over our deceased son, saying, “He’s a little cold, but he’s still alive,” has not been indicted.
 

Our son, Riku, died on July 30, 2022, while in temporary care at Midori no Suzuno Daycare Center, a childcare facility in Naha City.

On the day of the incident, the director instructed a staff member to place Riku on his stomach because he wouldn’t stop crying. Afterward, despite reports that something was wrong, she left our son unattended in a dimly lit corner of the room for several hours—without even checking on him during his nap—until I arrived to pick him up.

 

When I (Riku’s mother) went to pick him up, I was made to wait 15 minutes. Then, holding my deceased son in her arms, she handed him to me, saying, “He’s a little cold, but he’s still alive.” His eyes were open, his tongue was stiff—it was clear he was dead. (They testified that during those 15 minutes, they had given my deceased son a shower and changed his diaper.)

After that, I called an ambulance and performed CPR, but even during that time, the director just stood by watching and repeated statements that refused to acknowledge her responsibility, such as, “He’s alive because there’s a warm place.”

Her response, which showed no sign of panic and lacked any sense of sincerity, continued afterward, causing us even more anguish.

 

Despite having received improvement directives from Naha City following an on-site inspection regarding critical issues affecting children’s lives—such as “prevention of sudden infant death syndrome” and “ensuring adequate staffing levels”—this daycare center continued to operate as usual. In fact, just one month before the incident, a parent had reported that something was wrong with the facility. I have also heard from other parents that the childcare conditions there were terrible.

Despite the fact that my son lost his life amidst such appalling care conditions, the case was recently dismissed without prosecution.

Even after committing such a cruel act, they face absolutely no criminal charges.

 

We have serious doubts about whether this decision was truly appropriate. It is widely recognized that placing infants on their stomachs carries a significant risk of serious accidents, and childcare facilities are required to exercise extreme caution in such situations.

If things continue as they are, we may not be able to prevent similar accidents from happening again. In fact, there have been several similar fatal accidents involving infants placed on their stomachs even after Ryuku’s death. (There are also cases where charges were filed and guilty verdicts were handed down.)

What we are seeking is a re-examination of the facts and appropriate legal judgment and criminal punishment.

Specifically, we demand that a reinvestigation be conducted into this case and that a proper judgment be made, including the possibility of prosecution for abandonment of a person under one’s care or abandonment resulting in death.
