Received this email from MP Rob Flello which clarifies that the council CAN amend the pet shop licence so it doesn't include the sale of puppies. "Thank you for contacting me recently regarding the sale of puppies in pet shops. As you are aware, the sale of puppies and kittens in pet shops is an issue which was debated in the House of Commons on 4th September 2014 and gained huge cross-party support. Since then I have been working with PupAid and other organisations to press for further action on this issue. I was sorry to learn that Wokingham Borough Council are unclear on the interpretation of legislation relating to pet shops, which is a common finding amongst various councils, and is why I asked the Minister to clarify this point with local authorities following the debate in 2014. I have therefore included an extract of the Minister’s comments which can be found in Hansard of 4th September 2014: “George Eustice MP; It is important to recognise that only about 2% of pet shops sell cats and dogs—around 70 in total—and they are already regulated and licensed. They are regulated under the Pet Animals Act 1951. The hon. Member for Stoke-on-Trent South asked me to clarify whether local authorities have the additional power to place restrictions on which animals can be sold at a licensed pet shop establishment. I can confirm that they do have the power to restrict the number of animals that can be sold. He asked, too, about the issue of ambiguity and contestability in that context. Let me clarify that the intention of the provision is for local authorities to judge on a case-by-case basis whether a particular premise is suitable for a particular animal to be sold. It is not necessary for local authorities to change the law; it is for them to have considerable discretion in making a judgment about whether it is appropriate for certain animals to be sold on the authority’s premises.” I hope that this is helpful.
