Council Confirms Developer’s CCTV Excuse is Invalid & Insurance Concerns Escalate

The pattern of delay, selective communication, and shifting explanations continues:

5 August – NEDDC had to chase Evolution Homes for the overdue fortnightly update.
6 August – Lee Evans told the council the CCTV drain survey couldn’t get past a “U‑bend” due to “very old design” gullies, and that the matter was being referred back to Highways.
Same day – Residents received a generic “works proceeding as promised” email from Customer Care, omitting the CCTV issue entirely.
No response on Public Liability Insurance – Despite requests, no confirmation of valid public liability cover was provided.
26 August – Residents formally escalated the insurance lapse to the Health and Safety Executive (HSE), copying in relevant local authority officers.
27 August – Only after HSE were included did the developer respond, not with a renewed public liability policy covering the whole estate, but with a construction liability policy for Evolution Projects (Midlands) Ltd, expiring 31 October 2025.
Our concern – This appears to cover only the contractor’s on‑site works, not the unadopted roads, footways, drainage, streetlighting, or other incomplete communal areas. It does not address the three‑year gap in cover we believe existed between 2021 and June 2024.
22 August – DCC’s Adam Fenlon confirmed to residents that a CCTV survey should not fail because of a U‑bend, stating this is not an age or design issue and that gullies are built to allow survey equipment to pass beyond the trap. He confirmed no revised documentation or explanation had been received from the developer, and that the missed milestone will be recorded for the Local Planning Authority to consider in future enforcement or planning decisions.  We have escalated this and other evidence to the relevant authorities.

We continue to call on councils to suspend all planning approvals linked to Lee Evans and Evolution Homes Group until:

Public liability insurance is continuous and adequate
Infrastructure is completed to safe, legal standards
Buyers are protected from further harm
