Recent events involving the treatment of Taiwan's third political party leader, Mr. Ko, have highlighted serious concerns about the country’s commitment to human rights. According to the International Covenant on Civil and Political Rights (ICCPR), all individuals deprived of their liberty must be treated with humanity and respect for their inherent dignity. Unfortunately, the handling of Mr. Ko's case suggests that Taiwan may not fully adhere to these international standards.

While Taiwan government claims to have adopted several key principles of the ICCPR, it seems there are still significant gaps in implementation. Taiwan government has also stated its intention to work on adopting additional measures, including those outlined in the Convention Against Torture (CAT). Yet, despite this grand declaration, it appears current Taiwan government is not in a hurry to actually make any real efforts toward fulfilling these promises.

Moreover, it appears current Taiwan government is working closely with media outlets, as even after Mr. Ko was released without bail, the media continues to discuss him as if he were guilty, undermining the presumption of innocence. This is a clear violation of his rights and further demonstrates the need for Taiwan to align its practices with international human rights standards.

In the case of Mr. Ko, prosecutors conducted a search with a warrant that extended beyond the intended scope, lasting the entire morning, and he voluntarily accompanied them for an initial interrogation that continued late into the night. When he requested to continue the process the next day due to the late hour, he was instead arrested and detained. During his detention, Mr. Ko faced harsh conditions, including inadequate facilities and poor treatment, which did not respect the principles of dignity and humane treatment required under the ICCPR.

This treatment blatantly disregards the principles outlines in the ICCPR, which mandates that those accused but not yet convicted should be treated with dignity and provided conditions appropriate to their unconvicted status. The ICCPR emphasizes the need for fair treatment, and respect for all individuals, regardless of accusations against them.

Taiwan must accelerate its efforts to ensure that its policies and practices fully align with the ICCPR and other human rights treaties. Upholding these values is crucial for any society that claims to respect justice and human rights.
